Maplog Terms of Service
Version 1 · Effective date: [EFFECTIVE DATE]
This version: https://maplog.day/terms/v1 · Current version: https://maplog.day/terms
These Terms of Service ("these Terms") set out the conditions for using "Maplog", a service provided by ideaccept Inc. ("we", "us" or "our"). Maplog is a camera app that turns a day you spend with friends into a map video, just by taking photos. Location information is at the heart of how it works.
Before you use the Service, please read these Terms (including Chapter 10, which sets out how we handle location information) and the Privacy Policy (https://maplog.day/privacy). You may use the Service only if you agree to these Terms.
Key points
This summary is here to make these Terms easier to read. It is not legally binding, and the full text of these Terms prevails. For details about location information, see Chapter 10 (Location Information). For details about personal information, see the Privacy Policy.
- Location is at the core of Maplog. To record where you take photos and to detect which friends you're with, when you start we ask, with a separate checkbox for each item, for your consent to our obtaining and using your location information (Chapter 10) and to the provision of your Personal Location Information to third parties (such as friends) (Article 3(1)). Wherever you live, both are required consents for using the Service, and if you withdraw your consent to the provision to third parties, you can no longer use the Service. We carry out usage analytics only if you consent with the [Optional] checkbox. Separately, we ask for device permission to use your location while you're using the app (and, to take photos, your camera). These device permissions (location and camera) are not required. Without them, you can still view your friends' Posts, Logs and the map and use Settings, but features that use your own location (taking photos, Together detection, Friends nearby, People nearby and your walked route) are unavailable until you give the location permission (Article 10(2)). "Always" location access is optional. Even without it, every feature works while the app is open.
- We never show your current location (coordinates) to anyone, including your friends. We keep only your latest location on our servers, and we delete it if it isn't updated for 24 hours. While Ghost mode is on, we don't send it. The route you walk stays on your device only (it is recorded even while Ghost mode is on) and is deleted after 7 days. However, while you and a friend are both using the app (if you have allowed "Always", even while you have the app closed, for up to 60 minutes after your last location), Friends nearby lets that friend know that you are within about 300 m (and, within about 50 m, that you are "together").
- What friends can see: your posts and the points on the map where your Spots are (for 36 hours after you first take a photo at that Spot). The people you were with can see that post (until you delete it). Friends nearby can see your profile photo, your name, that you are within about 300 m, and whether you're "together". They can't see distance, direction or coordinates. Your Spots while Ghost mode is on are not shown to friends (Spots you take during Ghost mode stay hidden even after you turn it off). By default, Spots around your home (about 400 m) are not shown to friends (if you turn off "Hide my home on friends' map" in Settings, they are shown to friends like any other place, and friends may be able to tell roughly where you live).
- People nearby: if you are 18 or older (19 or older in the Republic of Korea), you are shown in People nearby by default (this is the same wherever you live; you can turn this off at any time with "Show me to people nearby" in Settings). While you are shown in People nearby, Maplog users within about 50 m (including people who aren't your friends) can see your profile photo, display name and ID, and they will know that you are nearby. Minors (under 18 in Japan and most other regions, and under 19 in the Republic of Korea) can't use People nearby and aren't shown in it (they can add friends by user ID search, QR code or friend link).
- Tools to protect yourself: Ghost mode, turning off "together" for individual friends, removing, blocking and reporting friends, setting your home, and deleting your account. Maplog is not a service for watching over people, emergency calls, navigation or tracking people. If you feel you are in danger, contact the police immediately.
- Sharing exported videos on external social networks is something you do yourself. Make sure the people in them are OK with it. Once a video has been shared, we can't delete it.
- What you must not do: try to find out other people's locations without permission, follow or stalk people, try to find out where someone lives, fake your location, take secret photos, impersonate others, and so on. We respond to violations by removing posts or suspending accounts, and we cooperate with the police in accordance with the law.
- Liability: We are not liable for damage that isn't our fault (such as location errors or detection errors, other users' conduct, what happens after you share something on an external social network, or a data leak caused by a third party's crime even though we had taken reasonable security measures). For damage caused by our slight negligence, our liability is limited to ordinary and direct damage (excluding damage arising from special circumstances and lost profits) and is capped at JPY 10,000 (or, if higher, the amount you paid us in the past 12 months; USD 100 in the United States). We do not limit liability for damage caused by our intent or gross negligence, damage resulting from harm to a person's life, body or health (meaning medically recognized injury or illness; neither is subject to the cap), or any liability that can't be limited under the laws of the country or region where you live. For users in the Republic of Korea, the same monetary cap applies to damage caused by our slight negligence (but the limitation to ordinary and direct damage and the exclusion of damage arising from special circumstances and lost profits do not apply), and there is no cap on liability under the personal information, location information and related laws (such as for leaks) or on damage resulting from harm to a person's life, body or health. For users in the EEA, UK and Switzerland, as set out in Article 61, our liability for slight negligence is limited to the damage that was typical and foreseeable when the contract was made, and the monetary cap applies only where we breach an obligation that is not an essential obligation (liability under data protection laws and product liability is not limited).
- Your liability: If we receive a claim from someone else because of your Posts or your breach of these Terms or the law (where you are at fault), you must resolve it at your own responsibility and expense and reimburse us for the amounts we paid (including reasonable attorneys' fees) (Article 37).
- Age: You must be 13 or older (14 or older in the Republic of Korea, and 16 or older in the EEA, UK and Switzerland). We ask for your date of birth when you start. You can't change your date of birth yourself later. Minors (under 18 in Japan and most other regions, and under 19 in the Republic of Korea) need consent from a parent or other legal guardian (if you are in Japan and under 16, we confirm on the date of birth screen that you have your parent's or guardian's consent).
- Changes: We will tell you about important changes at least 30 days before they take effect and ask you to agree again in the app. You can leave Maplog at any time, free of charge.
- Regional terms (Japan, Republic of Korea, EEA/UK/Switzerland and United States) take precedence over the main text. Users in the United States are subject to an arbitration agreement and waive class actions and jury trials. They can opt out of arbitration within 30 days after first agreeing to these Terms.
Chapter 1 General Provisions
Article 1 (Purpose and Application)
These Terms set out the conditions for using the Service we provide, and the rights and obligations between you and us.
These Terms are "standard terms" (teikei yakkan) as defined in the Civil Code of Japan. When you agree to these Terms in the way described in Article 3, you enter into a contract with us for the use of the Service on the terms set out here.
Chapter 10 (Location Information) of these Terms sets out how we handle location information and the conditions for the features that use it. As described in Article 3(2), we ask for your consent to our obtaining and using location information. Article 43(3) sets out how, in relation to Users who habitually reside in the Republic of Korea (Korean Users under Article 60), Chapter 10 and related provisions constitute the terms and conditions for location-based services under the Republic of Korea's Act on the Protection, Use, etc. of Location Information (the "Location Information Act").
We publish how we handle personal information in the Privacy Policy (https://maplog.day/privacy). The Privacy Policy is not part of these Terms; it is a document that sets out and explains how we handle personal information, which we are bound to follow. Wherever you live, we ask you to consent, with the checkbox in Article 3(1), item 2, to the collection and use of personal information as described in the Privacy Policy (for EEA/UK/Swiss Users, we do not treat this as consent under Article 6(1)(a) GDPR, as set out in Article 61(17)). Agreeing to the Privacy Policy does not replace any separate consent that the law requires for particular handling; where such consent is required, we ask for it separately, as described in Article 3(1), (2) and (4).
What applies where Chapter 10 and the other Chapters of these Terms differ on how location information is handled is set out in Article 43(2). The regional terms in Chapter 11 prevail over the other provisions of these Terms for the users they apply to.
These Terms do not change the obligations we owe under law in providing the Service (under the Consumer Contract Act, the Act on the Protection of Personal Information, the Telecommunications Business Act and other laws of Japan, and under the laws of the country or region that apply to you).
Article 2 (Definitions)
In these Terms, the following words have the following meanings:
(1) "Service": the "Maplog" app (including the App Clip) and website (https://maplog.day) provided by us, and the features that come with them.
(2) "User": a person who agrees to these Terms and uses the Service. This includes Guests. In these Terms, a User may be referred to as "you".
(3) "Account": the registration each User creates to use the Service, by signing in with Apple or Google, or as a Guest.
(4) "Guest": an Account created without signing in with Apple or Google (including one created from the App Clip).
(5) "Posts": anything a User takes, sends or saves on the Service. This includes photos, videos (including audio), captions, stars, comments, reviews, place names, profiles (user ID, display name and profile photo), and names added to Community Places.
(6) "Location Information": information about the place where a moving object or person is (or was) at a given time; specifically, the position of a User's device (latitude, longitude, accuracy, time, etc.) as measured by the device's operating system using the device's positioning functions (GPS, Wi-Fi, mobile network base stations, etc.), and where the User is as can be worked out from it.
(7) "Current Location": the single latest item of a User's Location Information (coordinates, accuracy and time) that is sent from the User's device to our servers and kept on our servers.
(8) "Spot": a place where a User took a photo or video. A Spot has a place name, a category and a point on the map (the "Spot point").
(9) "Capture Point": the location where each individual photo or video was taken, and its accuracy.
(10) "Friends": Users who have connected with each other on the Service through a request and acceptance.
(11) "Together detection": a feature that, when a photo or video is taken, compares the location of the person taking it with friends' Current Locations inside our servers, and estimates that friends who were nearby were "together" with that person.
(12) "People you were with": friends estimated by Together detection to have been together with the person who took the photo or video, and friends manually added to a Post as people who were together, excluding anyone removed later.
(13) "Friends nearby": a feature that, while both of you are using the app (if the person shown has allowed "Always", even while that person has the app closed, for up to 60 minutes after their last location), shows friends who are close by (within about 300 m), with their profile photo and name and whether you are "together".
(14) "People nearby": a feature that shows Users who have "Show me to people nearby" turned on, by profile photo, display name and ID, to other Users within about 50 m (including people who aren't their friends).
(15) "Home": the location of your home, as set by you.
(16) "Ghost mode": a setting that, while on, stops your Current Location from being sent to our servers, keeps you out of Together detection, and stops you from appearing in friends' feeds and maps, People nearby and Friends nearby. Even while it is on, the photos and videos you take, and their Spot points and Capture Points, continue to be saved as your own records, and your walked route continues to be recorded on your device (Article 53(2)).
(17) "Exported Videos": videos and images created from a Log or Posts.
(18) "Community Places": places that appear on every User's map when a User gives a name to a place that isn't on the map and takes a photo there.
(19) "External Services": services provided by anyone other than us. This includes Apple and Google services, external social networks, and map, search, notification and cloud services.
(20) "Legal Guardian": a minor's legal representative, such as a person with parental authority or a guardian of a minor.
(21) "Live Activities": the display shown on the iPhone Lock Screen and in the Dynamic Island.
(22) "Our Fault": intent or negligence on the part of us (including our representatives and the persons we employ or engage, including those we use to provide the Service).
(23) "Personal Location Information": Location Information about a specific individual. This includes information that does not identify a specific individual by itself but can easily be combined with other information to reveal that person's location. In the Service, it includes Current Locations, Spot points, Capture Points, Home locations and walked routes, as well as the results of determining that someone "was together" or "is nearby".
(24) "Personal Location Information Subject": the individual identified by Personal Location Information.
(25) "Location Features": the features of the Service that use Location Information (those listed in the table in Article 44).
(26) "Log": each User's record of Posts for one day (days are divided at 4:00 a.m. local time at the place where the photos were taken).
(27) "Location Disclosure Records": the records that our systems automatically keep of the fact that Personal Location Information was collected, used or provided to other Users. They correspond to the "data confirming the collection, use and provision of location information" under the Location Information Act. They do not include coordinates.
Article 3 (Consent and Versions)
Before you start using the Service (including when you start as a Guest or use the App Clip), you agree to these Terms on a screen in the app. Regardless of where you live or the language of the app, we use the same format for all Users: on the sign-in screen, we provide links to these Terms (including Chapter 10 (Location Information)) and the Privacy Policy, and ask for your consent item by item with the following checkboxes (there is also an "Agree to all" checkbox). We do not use a format in which you are treated as agreeing simply by tapping a sign-in button to continue. You can't start using the Service until you have agreed to all the [Required] checkboxes.
(1) [Required] Agree to the Terms of Service
(2) [Required] Agree to the collection and use of personal information (that screen shows the main items, purposes and retention periods, that you may refuse, and that if you refuse you can't use the Service)
(3) [Required] Agree to the collection and use of my location (paragraph 2; on the Korean-language screen, this is shown as consent to the terms and conditions for location-based services; Article 43(3))
(4) [Required] Agree to provide my location to third parties ("Provision of Personal Location Information to third parties" in the table in paragraph 4)
(5) [Optional] Agree to usage analytics and transfer abroad ("Usage analytics" in the table in paragraph 4)
If you were already using the Service and either have not agreed to the current version of these Terms or the Privacy Policy, or agreed under the format we used before this one (in which you were treated as agreeing by tapping a button to continue) and so have no record of consent under item 4, we will show a one-time confirmation screen the next time you open the app and ask for your consent with the same checkboxes as in this paragraph. You can't continue using the Service until you have agreed to all the [Required] checkboxes. Even if you don't agree, you can ask us to delete your account (Article 8) by contacting us.
To obtain and use your Location Information, we ask you to consent to our obtaining and using Location Information as set out in Chapter 10 (Location Information). This consent is referred to as "Location Consent". Wherever you live, we obtain Location Consent from all Users through a checkbox separate from the one for these Terms (paragraph 1, item 3). We also record it as Location Consent when you turn on the location row on the permissions screen (which says "Turning this on means you agree to the 'Location' section of the Terms"). For Korean Users (Article 60), Location Consent also constitutes consent to the terms and conditions for location-based services described in Article 43(3). Location Consent is a required consent for all Users to use the Service. Your device's location permission is not required; without it, you can't use the features that use your own location (taking photos, Together detection, Friends nearby, People nearby and your walked route), but you can use the other features (viewing your friends' Posts, Logs and the map, Settings, contacting us and so on) (Article 10(2)).
We do not vary how we obtain consent by region or by the language of the app. For the Privacy Policy, we ask all Users to consent to the collection and use of personal information with the checkbox in paragraph 1, item 2. What kind of consent or legal basis each checkbox in paragraph 1 corresponds to under the laws of each country or region is set out in Chapter 11 (for Japan, Article 59(6) and (7); for the Republic of Korea, Article 60(4); for the EEA, UK and Switzerland, Article 61(17); and for the United States, Article 62(10)). In particular, for EEA/UK/Swiss Users, we do not treat the [Required] checkboxes as consent under Article 6(1)(a) GDPR (Article 61(17)).
We carry out the following handling as you choose, through checkboxes, screens or switches that are separate from your agreement to these Terms.
Handling How consent works Provision of Personal Location Information to third parties (provision to friends, people you were with and Friends nearby: Together detection, showing the Spots you took, Friends nearby; Article 47) All Users: required consent (the checkbox in paragraph 1, item 4), because this is essential to the core features of the Service. You can withdraw it at any time with "Provide my location to third parties" in Settings (this switch is shown to Users in every country and region). If you don't consent or withdraw your consent, you can't use the Service (when you open the app, you will be asked to choose whether to consent again or delete your account). While you haven't consented (including after withdrawing), we exclude you from Together detection, showing Spots to friends, Friends nearby and People nearby, and don't send your Current Location to our servers. Spots you take while you haven't consented are not shown to friends even if you consent later. How this is treated under the laws of each country or region is set out in Article 59(7) (Japan), Article 60(4), item 2 (Republic of Korea), Article 61(17) (EEA, UK and Switzerland; the legal basis is performance of a contract) and Article 62(10) (United States) "Always" location (collecting location while the app is closed (even after it has been quit)) Optional. Off by default Being shown in People nearby (the "Show me to people nearby" setting) Optional. On by default for Users aged 18 or older (19 or older in the Republic of Korea), wherever they live; you can turn it off at any time in Settings. The note for the checkbox in paragraph 1, item 4 tells you that you may also be shown in People nearby, that it is on by default, and what others will see (your profile photo, name and ID), and we obtain your consent to it with that checkbox (Article 59(7) and Article 60(4), item 3). Not available to minors (under 18 in Japan and most other regions, and under 19 in the Republic of Korea) Usage analytics (PostHog and Google (Google Analytics for Firebase), both in the United States; see Article 25(3)) All Users: only if you consent (the [Optional] checkbox in paragraph 1, item 5; off by default). You can use every feature of the Service even if you don't consent. You can withdraw your consent at any time with "Share usage data" in Settings. Until you consent, not even automatically recorded events are sent. On the checkbox screen, the recipients are shown by type ("external analytics services (USA)"), and the details, such as the names and contact details of the companies, the items sent, when and how they are sent and the retention periods, are set out in the Privacy Policy (Sections 13 and 21.2 (4)). The "Details" link on that checkbox also shows the matters under Article 28-8(2) of the Personal Information Protection Act of the Republic of Korea (the name and contact details of the recipient, when and how the data is transferred, the purpose, the retention period, and how to refuse and the effect of refusing). For Users in every country and region, this consent includes consent to the transfer abroad (to the United States) for usage analytics (in the Republic of Korea, we treat it as optional consent under Article 28-8(1)1 of the Personal Information Protection Act, and in the EEA, UK and Switzerland, as consent under Article 6(1)(a) GDPR) Receiving, every 30 days, a combined version of the notices we send each time we provide your location (Republic of Korea; Article 50(3)) Optional. Off by default (if you don't consent, we will notify you each time we provide your location) [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)] Promotional notifications We don't currently send any. If we do, we will obtain separate consent beforehand Sending photos to AI (to determine the type (category) of a place that isn't on the map; Article 14) Optional. Before sending a photo for the first time, we ask you once, and we send photos only if you allow it. On the screen where we ask, we tell you which photo will be sent and the type of recipient (an external image recognition service (USA)), and, under "Details" on that screen, we show Users in every country and region the information on the transfer of personal information abroad (the items transferred, the country (the United States), when and how it is transferred, the name and contact details of the recipient (Cloudflare, Inc., privacyquestions@cloudflare.com), the purpose of use, the retention period, and how to refuse and what happens if you refuse; these are the items under Article 28-8(2) of the Personal Information Protection Act of the Republic of Korea). Until you answer, and if you don't allow it, we don't send photos. You can withdraw it at any time with "AI > Help build the map for everyone" in Settings. In the Republic of Korea this is optional consent, and in the EEA, UK and Switzerland it is consent (Article 6(1)(a) GDPR) You can withdraw the consents in the preceding paragraph at any time, for example from the app's Settings. If you withdraw a consent, the features based on it will no longer be available, but you can still use the other features (however, if you withdraw your consent to the provision of Personal Location Information to third parties, you can no longer use the Service, as shown in the table in the preceding paragraph). Withdrawal does not affect handling carried out before it.
We record every time you give consent, decline to give consent, or withdraw consent (including changes made with switches in Settings), by adding new records without overwriting old ones. We record who (the account identifier), what it concerns (the type and purpose of the consent), what was done (consented, declined or withdrew), which version (for consent to these Terms and the Privacy Policy, the document and its version), when (the date and time), on which screen (and, for consent given on the sign-in screen and similar screens, in which language), as well as the app version and the device's operating system. When you turn on location permission on the permissions screen, we also record this as Location Consent. When an account is deleted, we also record the deletion. We keep consent records for 3 years after the account is deleted, and delete them automatically once that period has passed. We will keep records of the use and provision of Location Information (which do not include coordinates) for 1 year [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)]. However, if a User who habitually resides in the Republic of Korea withdraws consent concerning Location Information (including by deleting their account), we will delete the records of the use and provision of Location Information within the scope withdrawn without delay, in accordance with Article 53(6).
These Terms and the Privacy Policy each have a version number (a whole number, such as Version 1 or Version 2) and an effective date. You can view the current versions at any time at https://maplog.day/terms and https://maplog.day/privacy, and past versions at https://maplog.day/terms/v{version number} and https://maplog.day/privacy/v{version number} (Version 1 of these Terms is at https://maplog.day/terms/v1). You can also view them in the app. If you ask, we will show you the content of these Terms without delay.
Article 4 (Changes to These Terms)
We may change these Terms under Article 548-4 of the Civil Code of Japan if either of the following applies:
(1) the change is in the general interest of Users; or
(2) the change does not go against the purpose of these Terms, and is reasonable in light of the need for the change, the appropriateness of the changed content, the nature of the change and other circumstances relating to it.
The main reasons we may change these Terms are:
(1) to respond to new or amended laws, or to decisions or guidance from courts or government authorities;
(2) for the safety of Users or third parties, for security, or to prevent fraud and abuse;
(3) to add, change or end features;
(4) because the terms of External Services have changed; and
(5) to reword these Terms so they are easier to understand.
We will announce that we are changing these Terms, the content of the changed Terms, the reasons for the change, the effective date, and a comparison of the text before and after the change, through in-app notices and on our website, by the following deadlines:
(1) changes that are favorable to Users, and minor changes: at least 7 days before the effective date
(2) changes that are unfavorable to Users, and important changes: at least 30 days before the effective date
For changes that are unfavorable to Users and important changes, we will notify you individually in the app and ask you to agree again in the app. If you don't agree, you can delete your account and leave the Service before the effective date (or at any time after it). Leaving is free of charge. Before you leave, you will have the chance to save your photos, videos and other content. A change that meets paragraph 1 takes effect on its effective date whether or not you agree to it (except changes that expand handling under paragraph 6; for users in the Republic of Korea and in the EEA, UK and Switzerland, Articles 60 and 61 apply).
How we notify changes to users in the Republic of Korea and in the EEA, UK and Switzerland, and how changes to the arbitration agreement work for users in the United States, are set out in Articles 60 to 62.
Changes to the Privacy Policy follow the provisions of the Privacy Policy. If we expand the purposes for which we use personal information or Location Information, the parties we provide it to, or the scope of the information we provide, we will obtain consent again from Users in every region before we start that handling. For Users who do not consent, we will not carry out the expanded use or provision.
Previous versions can be viewed on our website, as described in Article 3(7).
Chapter 2 Users and Accounts
Article 5 (Eligibility)
You must be 13 or older to use the Service. However, if you habitually reside in the Republic of Korea, you must be 14 or older (Article 60(10)), and if you habitually reside in the EEA, UK or Switzerland, you must be 16 or older. The Service is not directed at children under 13 (for US Users, see Article 62(12)). When you start using the Service, we ask for your date of birth to check your age (paragraph 7). If you are below this age, you can't use the Service. If a date of birth below this age is entered on the date of birth screen, we do not save it and you can't continue. If we learn that someone below this age is using the Service, we will stop their use and delete that account (and we will also delete that person's Personal Location Information without delay).
If you are a minor (under 18 in Japan and most other regions, and under 19 in the Republic of Korea, including if you are a minor under the laws of the country or region where you live), please get consent from your Legal Guardian before using the Service. Legal Guardians should review these Terms (including Chapter 10) and the Privacy Policy before giving consent. For people under 16 who habitually reside in Japan, we confirm that they have their Legal Guardian's consent through the "I have my parent or guardian's permission" checkbox on the screen where they enter their date of birth (based on Japan's Act on the Protection of Personal Information and Q&A 1-62 of the Personal Information Protection Commission, taking into account the 2026 (Reiwa 8) amendment to that Act). Without this check, you can't use the Service.
If a minor enters into the contract to use the Service without a Legal Guardian's consent, the law may allow that contract to be canceled. However, if the minor lied to make us believe they are an adult or that they have their Legal Guardian's consent (for example, by "fraudulent means" under Article 21 of the Civil Code of Japan or, for Korean Users, "fraudulent means by a person with limited capacity" under Article 17 of the Civil Act of the Republic of Korea), the contract may not be cancelable.
Minors (under 18 in Japan and most other regions, and under 19 in the Republic of Korea) can't use People nearby and aren't shown in it. We determine on our servers whether you are an adult, based on the date of birth you entered. If we can't confirm that you are an adult, such as when you haven't entered your date of birth, you can't use People nearby. Minors can also add friends by user ID search, QR code or friend link (a friend request has no effect unless the other person accepts it). The features available after you become friends do not differ by age. We are not liable for damage a User suffers as a result of misrepresenting their age, unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies, and the fact that the User misrepresented their age will be taken into account, in accordance with law, in determining the amount of damages.
You promise that you are not an organized crime group (boryokudan), a member of an organized crime group, a person who stopped being a member of an organized crime group less than five years ago, a quasi-member of an organized crime group, a company affiliated with an organized crime group, a corporate racketeer (sokaiya) or the like, a person engaging in criminal activities under the pretext of social campaigns, a special intellectual violent group, or any other person equivalent to these ("Anti-Social Forces"), and that you have no relationship with Anti-Social Forces that deserves social condemnation.
If we have previously deleted your account for violating these Terms, you may not use the Service unless we approve it again.
When you start using the Service (whether you start as a Guest or by signing in with Apple or Google), we ask for your date of birth. The screen where you enter your date of birth tells you that other people can't see it and that it can't be changed later (and, for people under 16 who habitually reside in Japan, that a parent's consent is needed; paragraph 2). We determine your age based on the date of birth you enter and do not check it against ID documents or similar. We use your date of birth only to check your age and to apply the restrictions for minors (paragraph 4), store it where only you can read it, and keep it until you delete your account. Once entered, your date of birth can't be changed, even by you. If you entered it incorrectly, please let us know through Contact us. If we learn that you entered a false age, we may suspend or delete your account under Article 24.
Article 6 (Registration and Sign-in)
You create an account by using Sign in with Apple, signing in with Google, or starting without signing in (as a Guest). If you open the App Clip from a friend's QR code or friend link, a Guest account is also created.
When you create an account, you choose a user ID and a display name. You can change your user ID later, but no more than once every 30 days (choosing it for the first time doesn't count). Anyone who searches for your exact user ID will see your user ID, display name and profile photo, even if they aren't your friend. The same information is shown to anyone who opens a friend link you have sent (https://maplog.day/user/ followed by your user ID) or your QR code. Because links can be forwarded, a link may reach people other than those you sent it to. When you change your user ID, we don't reserve your old user ID, and it becomes available to other users immediately. As a result, people who open a friend link or QR code with your old user ID, or who search for your old user ID, may be shown another user who has since taken that user ID. If you change your user ID, we recommend telling the people you sent your old link or QR code to about your new user ID. We are not liable for damage arising from your changing your user ID (including damage arising because an old link or QR code reached the user who has since taken that user ID), unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
The information you register must be accurate. You must not use another person's name or photo.
Guests can use all features in the same way, including adding friends, Together detection and comments. Guests' photos, videos and Posts are stored on our servers in the same way as those of signed-in Users. A Guest account may become permanently unusable if you delete the app, or lose or change your device. You can link a Guest account to Apple or Google sign-in from your profile, and we recommend that you do. If you sign in with Apple or Google after using a Guest account (including when you switch to an account that already exists), we move the Guest account's items to the account you signed in to. This is a transfer between your own accounts, not a provision to a third party. Before moving anything, we check on our servers that you hold the sign-in credentials for that Guest account (items can't be brought over from an account that isn't a Guest account). We move Logs, Spots, Posts (captions, stars and photo order), the photos and videos you took, records of being together, observations of whether you were together, comments, reviews, friend connections (including pending requests and blocks), records of the Community Places you added, Exported Videos (including the video files), records of notifications sent, reports, inquiries, consent records and notification destinations, as well as your date of birth and your Home location (the Home location is moved together with the "Hide my home on friends' map" setting; both are moved only if the account you signed in to doesn't have them yet). Logs for the same day are combined into one, and where both accounts have a review of the same Post or have added the same Community Place, we keep the one belonging to the account you signed in to. For friend connections, where the account you signed in to already has a connection (including a pending request or a block) with someone, we keep that account's connection and delete the Guest's (any connection between the account you signed in to and the Guest is also deleted). However, if either account has a block with that person (in either direction), the block is kept. We do not move the Guest's profile (user ID, display name and profile photo), Current Location or other settings. Moved items are treated as items of the account you signed in to: they are shown to that account's friends as set out in Article 11, and Ghost mode and the handling of areas around your Home (Article 11(3) and Article 13(4)) follow that account's settings and Home location (including a Home location moved from the Guest) (if the account you signed in to already has a Home location, the Guest's Home location is not moved, and Spots taken as a Guest are also judged against that account's Home location). Once the move is complete, we delete the Guest's storage for photos, videos and Exported Videos, and the Guest account. If the move fails partway, we delete neither account's data, and try again the next time you open the app (we also try again if only the deletion of the Guest account and its storage fails after the move). If the Guest's sign-in credentials can no longer be used, so that we can't confirm on our servers that the Guest account is yours, we do not move the Guest's items on our servers; only the Guest's items on your device become items of the account you signed in to. In that case, the Guest's items on our servers are deleted as an unused Guest account under paragraph 5.
We delete Guest accounts that have not been used for 1 year since they were last used. At least 30 days before deletion, we will let you know by notification (if you have allowed notifications). If you use the app during that period, we won't delete the account, and you can save your photos and videos or link the account to Apple or Google sign-in.
If we determine, on reasonable grounds, that a person trying to create an account falls under any of the following, we may refuse to let them create an account, or delete an account already created. In that case, we will tell them the reason.
(1) they do not meet the eligibility requirements in Article 5
(2) the information they register is false or impersonates someone else
(3) they are trying to create another account to get around a block or a measure we have taken
Photos and videos on your device, and their Spots, are treated as belonging to the account that was signed in when they were taken. The app shows, and sends to our servers, only those belonging to the account that is currently signed in (anything taken while there was no account at all, for example because there was no connection and a Guest account could not be created, will belong to the first account that signs in afterwards). If you sign in to a different account on the same device, the previous account's items remain on the device but are not shown (they will be shown again when you sign back in to that account). However, if you sign in with Apple or Google after using a Guest account (including when you switch to an account that already exists), the Guest's items on your device also become items of the account you signed in to, and anything not yet sent to our servers is sent under that account (paragraph 4). Guests have no sign-out option, and the sign-in screen does not show Guests the "Start without logging in" option (which would create a new Guest account) (if you sign in with Apple or Google, the Guest's items move to that account). If you delete a Guest account, we also delete the Guest's items on the device (Article 8). Items for which it can't be determined which account took them (and that have not yet been sent to our servers) are neither shown nor sent, and we will ask you to choose whether to treat them as yours or delete them from the device. If you delete an account on a device, we delete the items taken with that account that are stored on that device. Items taken with other accounts on the same device (and their Spots) remain (they are not shown). Items on other devices are deleted the next time the app is opened on that device, or as otherwise described in Article 8(2), item 6 and Article 8(3), item 9.
Article 7 (Account Management)
You are responsible for managing your account, the Apple ID or Google account you use to sign in, and your device (including its lock, such as a passcode or Face ID).
You must not let anyone else use your account, or transfer, lend or sell it. You must not use another person's account.
We treat any use authenticated through a registered Apple or Google sign-in, or through Guest credentials, as use by you. However, this does not apply where it is due to Our Fault (in that case, our liability is governed by Article 36).
If someone else uses your account (impersonates you) or you lose your device, let us know immediately and take steps such as changing your Apple or Google password. We may temporarily suspend the account to stop further harm.
We are not liable for damage caused by inadequate management of your device or account, unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
Article 8 (Leaving and Deleting Your Account)
You can delete your account and leave the Service at any time from the app's Settings. There is no charge.
When you delete your account, we immediately delete the following from our database and from the storage for photos and videos.
(1) your profile (user ID, display name and profile photo), date of birth, settings and Home location
(2) your Current Location
(3) photos and videos you took, Posts, captions, stars, comments, reviews, Spot points and Capture Points
(4) your friend connections, records of being together (including the marks on friends' Posts showing that you were with them), observations of whether you were together (which do not include coordinates), and rate-limit records and the stored answers for Friends nearby and Together detection (neither includes coordinates)
(5) notification destinations, and Exported Videos created on our servers
(6) data inside the app on the device on which you delete your account (the items taken with that account (the original files you took and photos and videos restored from our servers (Article 27(1))), the route you walked (including what was recorded while the app was closed; we also stop recording your location while the app is closed, and do not resume it until someone signs in again), the cache of found routes, places you re-selected yourself, that device's settings, etc. Items taken with other accounts on the same device (and their Spots) remain (they are not shown). The route you walked, the cache of found routes, places you re-selected yourself and that device's settings are deleted regardless of which account they belong to. Items on other devices are handled as set out in paragraph 3, item 9)
The following remain after you delete your account:
(1) anything shown on friends' devices, saved by friends, or exported and shared by friends
(2) anything you saved to your camera roll
(3) anything you shared on external social networks or elsewhere
(4) the content of your inquiries (with the link to you removed, for 3 years after we receive them)
(5) names, locations and categories of Community Places that other Users have also added (the link to you is removed)
(6) records we need to comply with the law or deal with disputes (consent records for 3 years after account deletion; records of reports for 3 years after we receive the report (if the person who made a report deletes their account, we keep the report with that person's identifier removed); records of the use and provision of Location Information for 1 year. Records of the use and provision of Location Information do not include coordinates. For Users who habitually reside in the Republic of Korea, records of the use and provision of Location Information are deleted without delay when the account is deleted (a withdrawal of all consent concerning Location Information), in accordance with Article 53(6))
(7) server access logs (up to 90 days [TO CONFIRM: retention period])
(8) backups (overwritten and deleted within up to 30 days [TO CONFIRM: retention period])
(9) data inside the app on devices other than the one on which you delete your account (the original files you took, photos and videos restored from our servers, the route you walked, etc.). These are deleted the next time the app is opened on that device, and we then also sign out and stop recording your location while the app is closed (until then, and when there is no connection or in similar cases, they remain). If the sign-in on that device has already ended, we delete the route you walked (including what was recorded while the app was closed) and the cache of found routes, and stop location recording (places you have re-selected yourself and that device's settings remain); the items you took remain on the device without being shown, and are deleted the next time someone signs in to a different account on that device. In either case, recording of your location while the app is closed is not resumed while no one is signed in. If that device had switched to a different account before the deletion, the deleted account's items remain on that device without being shown
Deleted accounts and data can't be restored. Save any important photos and videos before deleting your account.
A Guest account created with the App Clip can be deleted by installing the full app and deleting it there, or by asking us to delete it through Contact us.
Suspension of use and deletion of accounts by us are covered in Article 24.
Even after your contract to use the Service ends because you leave, your account is deleted (including deletion by us) or the Service ends (Article 30), Article 18(5) to (7), Article 19, Chapter 8 (Articles 31 to 37), Chapter 9 (Articles 38 to 42), Article 57 and Chapter 11 (Articles 58 to 63), any other provisions of these Terms on our liability (such as Article 26(4) and (5), Article 27(5) and Article 30(4)), and any rights and obligations that arose before the contract ended, remain in effect.
Chapter 3 The Service
Article 9 (What the Service Includes)
The main features of the Service are:
(1) Camera: take photos and videos (including audio).
(2) Map: shows where you are and its name, photos from Spots your friends took recently, and more, on a map.
(3) Spots and Posts: record where you took photos, combine the photos and videos (up to 3) you took at one Spot into a Post with a caption and stars, and choose how your photos are arranged.
(4) Comments and reviews: add comments and stars to Posts.
(5) Log: look back on your own days and see your friends' Posts.
(6) Together detection: estimates which friends were with you when you took a photo or video, and lets them know.
(7) Friends: become friends through requests and acceptance, QR codes, friend links, user ID search, or People nearby.
(8) Community Places: give a name to a place that isn't on the map and add it to the map.
(9) Export: turn your Log and Posts into videos and images, and share them on external social networks and elsewhere.
(10) Protection around your Home: hides the area around your Home from what friends see and in Exported Videos (both are on by default; you can turn off hiding from friends in Settings; you can turn off hiding your own Home in Exported Videos in Settings only for the "Map on top" layout, and it is always hidden in the "Photo on top" layout; the areas around the Homes of friends you were with are always hidden in Exported Videos).
(11) Notifications and Live Activities
(12) App Clip: lets people who haven't installed the app become friends through a friend's QR code or friend link.
The details of the Service are shown in in-app explanations and on our website. They may change under Article 29.
Article 10 (Features That Use Location Information)
The Service relies heavily on your device's Location Information. How we obtain and use Location Information and provide it to other Users, how long we keep it, how to stop it, and your rights are set out in Chapter 10 (Location Information).
Permission to use your location (while using the app) and your camera is not a condition of using the Service. Without them, you can still view your friends' Posts, Logs and the map, and use Settings, Contact us, the Privacy Policy and Delete account. However, features that use your own location (taking photos, Together detection, Friends nearby, People nearby and your walked route) are unavailable until you allow location, and we show this on the app's screens. To take photos, you also need to allow the camera. If you open the camera without these permissions, we guide you to a screen asking you to allow them. "Always" permission is optional, and even without it every feature works while the app is open. Microphone, notification and Motion & Fitness permissions are also optional.
Article 11 (Friends, Together Detection, Friends Nearby and People Nearby)
You become friends through a request and acceptance. You can remove or block a friend at any time.
Your friends can see:
(1) Posts you took (photos, videos, captions, stars, place names, categories, times and the points of your Spots on the map), for 36 hours after you first take a photo at that Spot (Posts you take later at the same Spot are shown for less than 36 hours after you take them). On map pins, the last place where you took a photo within the past 24 hours is shown with the photo and a label such as "35 min ago". If you take a photo while in a vehicle, the name of the area and the category "On the move" are shown instead of a shop name (and, on a plane, the place name "In the sky" and the category "Flight"), so others can tell that you were in a vehicle or on a plane (Article 15(2), item 4).
(2) Your profile photo and name, if a friend's Post lists you among the people they were with (only if the viewer is your friend).
The following are not shown even to your friends:
(1) your Current Location (coordinates), Capture Points and their accuracy, the route you walked, and your Home location
(2) while you are in Ghost mode, all your Posts and Spots (including those you took before turning Ghost mode on). Posts and Spots you took while in Ghost mode are not shown even after you turn Ghost mode off.
(3) Spots around your Home (about 400 m) (by default. If you turn off "Hide my home on friends' map" in Settings, Spots around your Home are also shown to friends like any other place, and friends may be able to tell roughly where you live. Your Home location itself is never shown, even if you turn this off)
Together detection works as follows:
(1) When a photo or video is taken, we compare the latest location of the person taking it held on our servers (used only if the Capture Point is within about 150 m of it) with friends' latest locations (sent within the last 10 minutes, or within the last 60 minutes for friends who have allowed "Always"), and estimate that friends who were within about 50 m (allowing for positioning error) were together.
(2) Detection takes place only inside our servers, and the other person's coordinates are never returned to anyone.
(3) The result (the IDs of the people you were with) is recorded with the Post, and those people are notified.
(4) Both the person who took the photo or video and anyone detected as having been with them can later remove a person from the people they were with on that Post. We record the removal and won't add that person again.
(5) You will no longer be detected if you turn off "together" for a specific friend, or turn on Ghost mode.
(6) Detection is an estimate, so it can miss people or get things wrong (Article 34).
The people you were with can see the Post until the person who posted it deletes it, and can write comments and reviews on it.
With Friends nearby, while both you and your friend are using the app (if you have allowed "Always", even while you have the app closed, for up to 60 minutes after your last location), friends within about 300 m are shown that you are nearby, your profile photo, your name and whether you are "together" (within about 50 m). Distance, direction and coordinates are not shown. Friends nearby are listed in order of name, not distance. You may not be shown to a friend, for example, right after that friend has made a large move, and there is a limit on how many times each friend can appear, disappear or change "together" status (Article 55(1), item 3).
People nearby works as follows:
(1) Only people who have "Show me to people nearby" turned on are shown. For Users aged 18 or older (19 or older in the Republic of Korea), it is on by default wherever they live, and you can turn it off at any time with "Show me to people nearby" in Settings. The note for the checkbox in Article 3(1), item 4 tells you that it is on by default. Minors (under 18 in Japan and most other regions, and under 19 in the Republic of Korea) can't use it and aren't shown.
(2) While "Show me to people nearby" is on, Maplog users within about 50 m (including people who aren't your friends) are shown your profile photo, display name and ID. Coordinates, distance and direction are not shown.
(3) You won't be shown while you are in Ghost mode, or to people you have blocked.
(4) Being shown in People nearby lets others know that you are very close by. They may also be able to tell who you are from your profile photo or name. Please use it only if you understand this risk, and turn off "Show me to people nearby" in Settings if you don't want to be shown.
(5) Only people who have turned on "Show me to people nearby" themselves, who are old enough to use People nearby (item 1) and who are not in Ghost mode can see other Users on the People nearby screen. People nearby are listed in order of name, not distance.
(6) You can't exchange messages or comments with people shown in People nearby until you become friends. All they can see is your profile photo, display name and ID, and that you are nearby.
Your profile photo, name and Posts are hidden from viewers who are not your friends (such as friends of your friends). The same applies to comments, the display of the people you were with, and Exported Videos.
For the provision of Personal Location Information to third parties (Together detection, showing the Spots you took, and Friends nearby), we obtain consent from Users in every country and region through a checkbox separate from the one for these Terms, as described in Article 3(1), item 4 and Article 3(4) (for EEA/UK/Swiss Users, the legal basis is performance of a contract, as set out in Article 61(17)). If a friend is outside Japan (for example, in the Republic of Korea), or, for Korean Users, outside the Republic of Korea (for example, in Japan), your Posts and Spots will be shown on that friend's device in that country. The note for that checkbox tells you that being shown to a friend in another country is a transfer to that country, and information about providing data to friends in other countries (such as that country's system for protecting personal information) is shown in the Privacy Policy (Article 59(8) and Article 60(4)).
If you remove or block a friend, from then on you will no longer see each other's Posts and Spots as friends, and you will no longer appear in each other's Together detection or Friends nearby. If you block someone, neither of you will be able to see the other's Posts and comments (including Posts from before the block on which you were together), and they will no longer be able to send you friend requests. If you only remove a friend, Posts from before the removal on which one of you was marked as a person the other was with remain visible to that person, as set out in paragraph 5. We don't tell the other person that you blocked them. You can see the people you have blocked under "Blocked people" in your friends list and unblock them at any time. Unblocking doesn't make you friends again; to become friends again, one of you needs to send a new friend request. If you have both blocked each other, each block stays in place, and if one of you unblocks, the other's block continues.
Article 12 (Safety Features and Precautions)
The Service has the following features to help you protect yourself:
(1) Ghost mode
(2) Turning off "together" detection for individual friends
(3) Removing and blocking friends (including unblocking from the list of blocked people)
(4) Reporting (users, Posts and comments; you choose a reason and can also add a more detailed description)
(5) Turning being shown in People nearby on or off (the default is as set out in Article 11(7), item 1)
(6) Setting your Home (including the "Hide my home on friends' map" setting and the "Hide my home" setting for exports)
(7) Removing yourself from the people a friend was with on their Post
(8) Turning off each type of notification, and turning off Live Activities
(9) Deleting your account
(10) Changing location permissions in your device settings
For your own safety, please keep the following in mind:
(1) Only add people you actually know and trust as friends. Your friends will learn where and when you took photos, that you were with them, and that you are nearby.
(2) People nearby is for becoming friends with people who are with you right there and then; it is not a way to meet strangers. Don't arrange to meet someone you have only seen in People nearby.
(3) The background of a photo, the time it was taken or the place name may reveal where you are, or your home, school, workplace or places you often go. Posts that friends take near your home are shown according to those friends' settings.
(4) If you are shown in People nearby, strangers within about 50 m can also see your profile photo, display name and ID, and that you are very close by. Coordinates and distance are not shown, but someone may still be able to find you by looking around. We also can't completely prevent someone who fakes their location from finding out whether you are in a particular area (Article 55(3)). Take particular care in crowded places or when you are alone. If you are 18 or older (19 or older in the Republic of Korea), you may be shown in People nearby by default (Article 11(7), item 1). If you don't want to be shown, turn off "Show me to people nearby" in Settings.
(5) The feature that hides the area around your Home can't completely stop others from guessing where you live. If you turn off "Hide my home on friends' map" in Settings or "Hide my home" in the export settings, friends or people who watch your Exported Videos may be able to tell roughly where you live.
(6) If someone bothers you, or if you feel unsafe, use blocking, removing friends, reporting and Ghost mode.
(7) If you feel you are in danger, contact the police or other authorities immediately (110 or 119 in Japan, 112 or 119 in the Republic of Korea, 911 in the United States and 112 in the EU; in other countries and regions, the local emergency number). The Service is not a substitute for emergency calls.
(8) Don't use the Service while driving a car or riding a bicycle, while walking, or in dangerous places.
(9) Lock your device and don't hand it to others.
The Service is not intended for watching over people, crime prevention, emergency reporting, checking that people are safe, navigation (route guidance), or finding or following where people are (tracking people). Do not rely on the Service to find out where someone is, or to protect anyone's life or physical safety.
When we receive a report, we will review it within 24 hours (except where circumstances beyond our reasonable control prevent this) and take the necessary measures, as described in Article 24.
Article 13 (Exporting and Sharing to External Services)
Exported Videos are created on your device and are not sent to our servers. If you use a feature that creates Exported Videos on our servers, we keep the created video on our servers for 30 days and then delete it.
Exported Videos include the map, the route you walked (as a line), place names, captions, stars, times, your photos and videos, and the profile photos and display names of the friends you were with (Article 20). People who are not friends with the person exporting are left out.
The map in Exported Videos includes the map attribution (© OpenMapTiles © OpenStreetMap contributors). You must not remove or hide the attribution.
For Spots around a Home, the map in the Exported Video is hidden and the place name is shown as "Home". Whether a Spot is around a Home is determined using a circle whose center is offset so that the location of the Home can't be worked out. The areas around the Homes of the people you were with are always hidden in the same way, regardless of the setting below. When "Hide my home" (on by default) in the export settings is on, or in the "Photo on top" layout, route lines around your own Home are not drawn either. In the "Map on top" layout, if you turn off "Hide my home", route lines around your own Home are drawn on the map (Spots around your Home are still hidden as "Home" regardless of this setting). Route lines are not drawn just before and after hidden Spots. The area around the home of someone who hasn't set a Home can't be hidden. Even for hidden Spots, the photos and videos are included in the video under the name "Home", so viewers can tell that those photos and videos were taken around a home. In addition, the location may be identifiable from the background of photos, the times, the Spots before and after, and so on, and we do not promise that your Home can be completely hidden. If you visited a friend's home that day, show the Exported Video to that friend before sharing it.
Sharing Exported Videos on external social networks (such as TikTok and Instagram) is your own act. Before sharing, it is your responsibility, as the person sharing, to make sure that the people who appear in the video and the people whose names appear in it agree. You must not publish other people's locations, Spots or clues to their homes without their consent.
Shared Exported Videos are handled under the terms and privacy policy of the service they were shared to. We cannot delete videos that have been shared or change who can see them.
We are not liable for damage caused by Exported Videos after they have been shared, unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
Article 14 (Automated Processing by AI)
When a place that isn't on the map is added to Community Places, we use AI. The AI determines the place's category (such as "Café" or "Vintage clothing") and a more specific type, and produces the specific type in Japanese, Korean and English. The AI does not translate place names (the Japanese, Korean and English names of a place you chose in place search come from the name suggestions in place search; Article 15(2), item 2). We send the place name and display language (not your name, ID or location) to Cloudflare, Inc.'s Workers AI (using Google's Gemma model). Along with them, if you have given permission as set out in the next paragraph, we send a photo you took at that place with the rear camera (we never send photos taken with the front camera), reduced to 512 px on the long side with location and other metadata removed, solely to determine the type (category) of the place. We do not store the photos we send [TO CONFIRM: Cloudflare Workers AI terms (storage of inputs and training)].
We send photos to AI only for Users who have given permission. Before sending a photo for the first time (when you first choose a place that isn't on the map), we ask you once whether you allow it. On that screen, we tell you which photo will be sent (a photo taken with the rear camera, 512 px on the long side, with location and other metadata removed), the type of recipient (an external image recognition service (USA)), the purpose (determining the type of place) and that the photo is not stored, and, under "Details" on that screen, we show Users in every country and region the information on the transfer of personal information abroad (the items transferred, the country to which they are transferred (the United States), when and how they are transferred, the name and contact details of the recipient (Cloudflare, Inc., privacyquestions@cloudflare.com), the recipient's purpose of use and retention period, and how to refuse and what happens if you refuse; these are the items under Article 28-8(2) of the Personal Information Protection Act of the Republic of Korea). Until you answer, and if you don't allow it, we don't send photos, and the AI determines the category from the place name only. You can withdraw your permission at any time with "AI > Help build the map for everyone" in the app settings (this does not affect photos sent before you withdraw). We don't send photos taken with the front camera, or videos, even if you have given permission. If a place isn't added to Community Places, neither its name nor any photo is sent to AI (Article 15(5)).
The AI chooses categories only from the list of map categories we have set. The AI does not assign specific types relating to adult entertainment, medical care or politics. AI results (including the specific types in Japanese, Korean and English) may be inaccurate or inappropriate, and we do not promise that AI results are accurate. You and third parties can report errors in the results. We will review reports within a reasonable period and correct results where necessary. If we receive a report of an error that may harm someone's reputation, credit or privacy, we will not show that type until our review is complete.
We do not make decisions that significantly affect your rights based solely on AI or other automated processing. Measures such as suspending an account are taken only after review by a person.
Damage resulting from AI results is governed by Article 34.
Article 15 (Maps and Place Information)
Maps in the Service use OpenStreetMap data (© OpenStreetMap contributors, Open Database License) in the OpenMapTiles format (© OpenMapTiles). Map tiles are served by us (tiles.maplog.day, using Cloudflare, Inc.'s infrastructure), and when this happens, the tile numbers for the area you are viewing and for the stretches between places when a route is drawn on the map in your Log (including where the recording has gaps) (which reveal your approximate location), and your device's IP address, are sent to our tile server. For maps outside Japan and the Republic of Korea, maps zoomed out to show a wide area, and maps that cross the boundaries of our map data coverage (each region of Japan, and the Republic of Korea), our servers fetch the tiles from OpenFreeMap on your behalf (your IP address is not sent to OpenFreeMap). Only the map text (fonts) is fetched by your device directly from OpenFreeMap, so your device's IP address is sent to OpenFreeMap (your location is not).
To show place names and addresses, we use the following. For items (2) and (3), we send only the information needed for the search, and never your ID or name. Under Japan's Act on the Protection of Personal Information, because both companies may also handle the information sent to them under their own policies, we treat what we send to items (2) and (3) not as an entrustment but as a provision to a third party (a provision to a third party in a foreign country; Articles 27 and 28 of that Act), and we send it on the basis of Location Consent (Article 3(2)). The personal information protection systems of the United States and the Republic of Korea, and the measures both companies take, are set out in section 8 of the Privacy Policy ("Outsourcing and external providers").
(1) map data (OpenStreetMap) and names you have re-selected before (on your device)
(2) searching for places, and showing name candidates (in Japanese, Korean and English): Google's Places API (our servers send the coordinates of the center of the search, the search terms, the language and the place ID)
(3) searching for nearby places within the Republic of Korea: Kakao's Kakao Local (our servers send coordinates to search for nearby places)
(4) searching for place names and addresses: your device's iOS features (your Current Location, the coordinates of the places where you took photos, and the address you enter when looking up your Home are passed to Apple). If you take a photo while in a vehicle (moving at 30 km/h or more when you take it), we don't attach a shop name, and instead use the name of the area (the name of the city or town) and the category "On the move"; at 200 km/h or more, or at an altitude of 3,000 m or more, the place name is "In the sky" and the category is "Flight" (your speed and altitude when you take a photo are used only on your device for this determination and are not sent; places named "On the move" or "In the sky" are not added to Community Places). The coordinates of the place where you took a photo are passed to Apple to attach the name of the area: at the time you take it, if you took it in a vehicle, or when it is uploaded, if no name could be attached because there was no signal.
(5) calculating walking routes: calculated on your device from the roads and railways in the map tiles. Coordinates are not sent anywhere.
If you use Google search, the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy also apply [TO CONFIRM: Google Maps Platform's end-user notice requirements].
Maps, place names, categories, addresses and routes may be wrong, out of date or missing. Routes are there to show your records, not to guide you.
If you choose or enter a name for a place that isn't on the map and take a photo there, the place's name, location and category appear on every User's map as part of Community Places. The name shown in Community Places is the name you chose or entered (if you chose the place in place search, whichever of its Japanese, Korean and English names matches the viewer's language); it is a Post (Article 2, item 5), and Article 19 (Your Promises) and Article 37 (Your Liability) apply to it. On the screen where you choose the name, we tell you that the name will appear on every User's map, and that the name will be sent to AI to determine the type of place (and, if you have given permission, a photo taken with the rear camera as well; Article 14). We don't show other Users who added a place, when, or how many people added it. However, the person who added a place may be guessed from the place and the timing. Places are not added within about 400 m of the adding User's Home. Places are also not added while the adding User is in Ghost mode, or from Spots taken while they were in Ghost mode. If other Users have also added the same place, it stays even if you delete your account (the link to you is removed).
You can report places that are wrong or inappropriate. Under Article 21, we may correct or delete the names and categories of Community Places.
Damage resulting from errors in maps and place information is governed by Article 34.
Article 16 (Notifications and Live Activities)
We use notifications to let you know about friend requests and acceptances, photos taken together, comments and reviews, finished videos, and more. Notification text includes friends' display names and place names. Notifications are delivered through services provided by 650 Industries, Inc. (Expo) and Apple, and also appear on the Lock Screen.
You can turn off each type of notification in the app's Settings. You can also turn off all notifications in your device settings.
For users in the Republic of Korea, in accordance with Article 50, we will notify you each time we provide your location to friends or others [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)].
Live Activities are created only on your device. They show on the Lock Screen and in the Dynamic Island the name of where you are, "category · area", the initials of the people you are with, how many photos you have taken today, and more. Your location is not sent anywhere. This is on by default, and you can turn it off in the app's Settings.
Anyone who can see your device's screen can see Lock Screen notifications and Live Activities. If this concerns you, turn them off, or set your device so that notification content isn't shown on the Lock Screen (on iPhone, the "Show Previews" setting).
We don't currently send promotional notifications. If we do, we will obtain separate consent beforehand.
Article 17 (Fees)
The Service is currently free.
You are responsible for any data charges for using the Service.
If we introduce paid features, we will separately set out and show the price, what you get, payment methods and how to cancel, and obtain your agreement before you buy. Those conditions will provide that, if a paid feature does not conform to the contract, we will fix it or reduce the price (give a refund), and will set out how damages are handled in that case.
Chapter 4 Posts
Article 18 (Rights in Posts and License)
Copyright and other rights in Posts stay with the User who posted them (or the original rights holder). They are not transferred to us.
You grant us a free, non-exclusive, worldwide license (including in the countries where data is stored and processed) to use your Posts (including storing, reproducing, resizing, converting formats, displaying, transmitting, and making them available to the people you choose) to the extent necessary for the following purposes:
(1) providing the Service (including showing Posts to the people you were with and to friends, showing your profile photo and display name in friends' Exported Videos (Article 20), notifications, and showing Community Places)
(2) fixing bugs in and improving the Service
(3) investigating and preventing fraud and violations of these Terms, and protecting the safety of Users and third parties
(4) responding in accordance with the law
When we use Posts for "improving" the Service under the preceding paragraph, we do so within the scope of the purposes of use set out in the Privacy Policy.
Within the purposes in the preceding paragraphs, we may have the service providers listed in the Privacy Policy carry out the use described in paragraph 2.
The license in paragraph 2 ends when you delete the Post or delete your account. However, this does not apply to:
(1) Exported Videos that friends have already created or shared in line with Article 20
(2) Community Places under Article 15(5)
(3) the items that remain under Article 8(3)
Unless you give separate consent, we will not use your Posts for advertising or promotion, and we will not sell them to third parties.
Within the purposes in paragraph 2, you will not exercise your moral rights against us or against Users who use your Posts in line with these Terms (for example, for resizing, cropping, or combining them in Exported Videos).
The rights in the Service (the app, designs, logos, map styles, illustrations and so on) belong to us or to those who have licensed them to us. We grant you a non-transferable, non-exclusive right to use the Service for personal purposes in accordance with these Terms.
Article 19 (Your Promises)
You promise the following about your Posts:
(1) you have the rights needed to post them, or permission from the rights holder;
(2) you have the consent of the people who appear in them (including your friends), and they do not infringe those people's portrait rights or privacy. If a child appears, you have the consent of the child's parent or guardian;
(3) you did not take them without the manager's permission in a place where photography is prohibited (cinemas, museums, live music venues, shops that don't allow photography, schools, other people's homes, etc.);
(4) you did not take them secretly, by voyeurism, or without the subject's consent;
(5) you did not use the absence of a shutter sound to photograph anyone without consent (outside certain regions such as the Republic of Korea, the Service does not play a shutter sound when you take photos; the people you photograph must still consent); and
(6) they do not infringe the law or the rights of third parties.
If you break these promises, your liability is governed by Article 37.
Article 20 (Appearing in Friends' Exported Videos)
When a friend you were with creates an Exported Video, the video includes your profile photo and display name as a person they were with (if, when the friend exports, you are marked on that friend's Post as a person they were with and you are friends with them). Photos and videos you took are not included in friends' Exported Videos.
Each User permits the friends they were with, and us, to include that User's profile photo and display name, as a person they were with, in that day's Exported Videos and to share them on external social networks or elsewhere.
To keep your profile photo and display name out of a friend's Exported Video, remove yourself from the people they were with on that Post (Article 11(4), item 4). They are also not included while you are in Ghost mode.
Removing yourself does not affect Exported Videos that have already been created or anything that has already been shared.
The profile photos and names of people who are not friends with the person exporting are not included.
The responsibilities of people who share Exported Videos are set out in Article 13.
Article 21 (Hiding and Removing Posts)
If we determine, on reasonable grounds, that a Post falls under any of the following, we may hide or delete it, or correct the name or category of a place in Community Places:
(1) it falls under the prohibited conduct in Article 23;
(2) it violates the law, or there are reasonable grounds for a notice of rights infringement under Article 22;
(3) it is child sexual content, was taken secretly, or is sexual content taken without the subject's consent;
(4) there is imminent danger to a person's life, body or safety;
(5) we receive an order or request from a court or government authority;
(6) the name or category of a place in Community Places is clearly untrue, is a prank, or points to the place of a specific person, such as a private home; or
(7) any case similar to the above in which there is a risk of harm to the safety or rights of other Users or third parties.
Before taking a measure under the preceding paragraph, we will tell the User who posted the content the reason and give them a chance to respond. However, in the urgent cases in Article 24(3), we will tell them the reason promptly after taking the measure.
The User who posted the content may appeal the measure. A person will review it, and we will tell you the result.
We are not liable for damage to Users caused by measures under the preceding paragraphs (including measures to stop transmission under the Information Distribution Platform Act, as described in Article 22(2)) unless it is due to Our Fault. Where that Act denies our liability, that Act applies. If it is due to our slight negligence, Article 36 applies.
Article 22 (Notices of Rights Infringement)
Anyone who believes a Post infringes their rights, such as copyright, portrait rights, privacy or reputation, can send a notice to our contact point (Contact us in the app, or contact@ideaccept.com). The notice should include the Post concerned, the right infringed, why you believe it is infringed, your contact details, and a statement that the information is accurate.
We will review the notice and, after asking the User who posted the content for their view where necessary, take measures such as hiding or deleting it. Where the Act on Measures against Infringement of Rights Caused by the Distribution of Information through Specified Telecommunications (the Information Distribution Platform Act) applies, we may, in accordance with that Act, ask the User who posted the content for their view and, if they don't object within 7 days, take measures to stop it from being transmitted.
Posts that only a limited group of people, such as friends, can see may not be covered by that Act. Even then, we will deal with the matter under these Terms using the same procedure.
We may disclose information about the User who posted content in response to a disclosure request made under the law or a court order. In that case, as a rule, we will ask the User who posted it for their view in accordance with the law.
The procedures for notices concerning users in the Republic of Korea, in the EEA, UK and Switzerland, and in the United States are set out in Articles 60 to 62.
You must not send a notice that you know to be untrue.
Chapter 5 Prohibited Conduct
Article 23 (Prohibited Conduct)
When using the Service, you must not:
(1) try to find out another person's location without their permission; or record, store, forward or publish another person's location, Spots, the fact that they were together with someone or the fact that they are nearby, without their permission (including by screenshots and screen recordings);
(2) follow someone, lie in wait for them, watch them, show up uninvited, loiter near their home or similar places, or do anything else that violates or may violate the Act on Regulation of Stalking Behavior, etc. (the Anti-Stalking Act) or similar laws of other countries;
(3) install the Service on another person's device without their permission; sign in on another person's device or account; or lend or borrow devices or accounts to find out someone's location without their knowledge;
(4) use the Service to watch over, monitor or track a spouse, partner, family member, acquaintance, employee, student or anyone else; or pressure anyone to become friends, turn on settings that share their location (including turning on People nearby), turn off Ghost mode, or keep "together" turned on;
(5) fake your location (using location-changing apps or devices, modified devices or apps, emulators, etc.); or use People nearby, Friends nearby or the way Together detection works to try to work out where another person is, where they live or what they are doing (including checking repeatedly while changing your own location);
(6) identify or infer another person's home, school, workplace or the like, publish it in a way that makes it identifiable, or approach the person at a place you have inferred;
(7) approach a minor (including anyone under 18, and anyone under 19 in the Republic of Korea) for sexual or other improper purposes; or use the Service to meet strangers or for dating;
(8) take photos secretly, by voyeurism or without the subject's consent; take photos without the manager's permission in places where photography is prohibited; or take advantage of the absence of a shutter sound to photograph people without their knowledge;
(9) take, post or share child sexual content (photos, videos or text that sexualize children);
(10) impersonate another person, or register false information;
(11) harass, threaten, defame, discriminate against or bully others;
(12) publish another person's photos, face, name, location or Spots outside the Service without their consent;
(13) post content that promotes violence, terrorism, self-harm or suicide, illegal drugs and the like, obscene content, or other illegal content;
(14) infringe the copyrights, trademarks, portrait rights, privacy, reputation or other rights of us or third parties (including removing or hiding the map attribution in Exported Videos (Article 13(3)));
(15) gain unauthorized access, or send viruses or other harmful programs; or get around the Service's security or rate limits;
(16) operate the Service automatically with bots, scripts or the like, scrape it, or call our APIs in ways we have not authorized; or, except where the law allows, analyze (reverse engineer) or modify the Service;
(17) improperly collect other Users' personal information;
(18) engage in sales, advertising, solicitation or spam that we have not authorized;
(19) keep sending friend requests that have been declined; persistently send friend requests to people you don't know; or create another account to get around a block or a measure we have taken;
(20) make false reports or abuse the reporting system;
(21) provide any benefit to Anti-Social Forces;
(22) violate the law or public order and morals; or
(23) do anything similar to the above that may harm the safety or rights of other Users or third parties.
Article 24 (Measures Against Violations)
We have zero tolerance for objectionable Posts and for Users who harm other Users.
If we determine, on reasonable grounds, that a User has violated Article 23, we may take the following measures, depending on the nature and seriousness of the violation:
(1) a warning
(2) hiding or deleting Posts
(3) restricting features (People nearby, friend requests, comments, etc.)
(4) suspending use for a set period
(5) deleting the account and refusing re-registration
(6) consulting with and providing information to the police or other authorities in accordance with the law
Before taking a measure, we will tell the User the reason and give them a chance to respond. However, in the following urgent cases, we will tell them the reason and how to appeal promptly after taking the measure:
(1) there is imminent danger to a person's life, body, property or safety
(2) following or stalking is suspected
(3) child sexual content is involved
(4) the law or a request from the authorities requires us to act immediately
(5) telling the User in advance could allow the violation to continue or evidence to be destroyed
When we take the measure of deleting an account, we will endeavor to give the User a period to save their own photos and videos before deletion, except in cases falling under Article 21(1), item 3 and where law or the authorities require immediate deletion.
When we receive a report, we will review it within 24 hours (except where circumstances beyond our reasonable control prevent this) and, if there is a violation, take measures that include removing the Post and removing the User who posted it. When a report is made, our staff will check the reported Post, comment, profile or other content. We tell people who make reports about this on the reporting screen, and by sending a report they consent to it. These reviews and measures are for removing Posts and Users that violate these Terms from the Service. We can't stop what a reported User does outside the Service, and receiving a report does not mean we promise to keep the reporting User safe. If there is an imminent danger to someone's life or body, contact the police or other authorities immediately without waiting for a report to be handled (Article 12(2), item 7).
We deal with objectionable content through reports and review by our staff. We do not currently check Posts with automated filters. Accounts are suspended or deleted only after review by a person. We apply measures according to consistent standards.
Users who are subject to a measure can appeal through Contact us in the app or by other means. A person will review the appeal, and we will tell you the result.
We may provide User information in response to inquiries from investigative authorities made under the law, warrants or other legal requests. We may also provide it, to the extent the law allows, where it is necessary to protect a person's life, body or property and it is difficult to get the person's consent. However, the provision of Location Information (including your Current Location, Spot points, Capture Points and Home location) to investigative authorities and rescue authorities is governed by Article 49(3). Details are set out in the Privacy Policy.
We are not liable for damage to Users caused by measures under the preceding paragraphs or under Article 5(1) and (7), Article 6(6) and Article 7(4) unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
Chapter 6 Privacy and Information Security
Article 25 (Personal Information)
We handle your personal information in accordance with the Privacy Policy. We also handle Location Information in accordance with Chapter 10.
Where the law requires consent for any handling, we obtain your consent separately before carrying it out, as described in Article 3.
We do not sell personal information. We do not track you for advertising (tracking across other companies' apps or websites), and we do not collect the advertising identifier (IDFA). For usage analytics, we use services from PostHog, Inc. and Google LLC (Google Analytics for Firebase) (both are service providers of ours in the United States, and we do not allow them to use the data for their own purposes). We do not send Location Information, place names, photos or photo URLs, the text of captions or comments, names or email addresses to our usage analytics providers. PostHog is set up not to estimate location from IP addresses. Google may estimate your approximate country or region from your IP address, but we have set it not to collect more precise location, such as your city [TO CONFIRM: turn off granular location and device data collection in Google Analytics]. Wherever you live, we carry out usage analytics only for Users who consent with the [Optional] checkbox in Article 3(1), item 5. The Privacy Policy explains what we send for analytics, the names and contact details of the recipient companies, and how to withdraw your consent ("Share usage data" in the app's Settings).
We will not look at, use or disclose information protected by the secrecy of communications (such as Posts and comments that only a limited group of people, like friends or the people you were with, can see, and who was together with whom), except for the processing needed to provide the Service (sending and showing it to the people the User chooses) and in the following cases:
(1) where the parties to the communication have given individual consent (for example, where a person who makes a report consents to our staff checking the reported Post or comment)
(2) where required by law
(3) where urgently necessary to protect a person's life or body
(4) to the minimum extent necessary to deal with outages, unauthorized access or spam
You can ask us to disclose, correct, delete or stop using your personal information, withdraw your consent, and so on. How to do this is set out in the Privacy Policy.
Article 26 (Information Security and Response to Leaks)
To protect Users' information, we take reasonable security measures (technical and organizational measures) and keep improving them. The main ones are listed below, and the Privacy Policy gives more details:
(1) taking the measures in Article 55 for Location Information
(2) storing photos and videos in non-public storage, and showing them through short-lived URLs only after checking that the viewer is allowed to see them
(3) removing location and other metadata from photos and videos before uploading them
(4) encrypting communications, and keeping stored data in an encrypted environment
(5) limiting the staff who can access data, and keeping records of that access
No online service can be made completely secure. We do not promise that information will never be leaked, lost, altered or accessed without authorization. This paragraph does not release us from liability.
If we become aware of a leak, loss, damage or similar incident (including a suspected one, and including cases where a setting such as Ghost mode, blocking or protection around your Home fails because of a defect and information becomes visible to people who should not see it), we will:
(1) investigate immediately and stop further harm (including hiding any information that became visible), suspending all or part of the Service if necessary;
(2) report to the Personal Information Protection Commission and other authorities as required by law. In the Republic of Korea, where required by law (such as incidents involving the information of 1,000 or more people, sensitive or unique identifying information, or unlawful access from outside), we will report to that country's Personal Information Protection Commission or the Korea Internet & Security Agency within 72 hours under Article 34 of the Personal Information Protection Act of the Republic of Korea, and we will report security breaches under Article 48-3 of the Act on Promotion of Information and Communications Network Utilization and Information Protection to the Minister of Science and ICT or the Korea Internet & Security Agency within 24 hours; and
(3) tell affected Users, through in-app notices, notifications, email or other means, what happened, what information was involved, what you can do, and where to contact us. For Korean Users, within 72 hours after we become aware that a leak or similar incident has occurred or may have occurred, we will tell you the items involved, when and how it happened, what you can do to reduce harm, our response and the procedures for remedies, the responsible department and its contact details, and your rights to compensation (including statutory damages), dispute mediation and so on, and how to exercise them (Article 34 of the Personal Information Protection Act of the Republic of Korea).
The fact that we carried out the investigation, reporting or notification described in the preceding paragraph does not mean that we admit liability. If a leak or similar incident causes damage to Users, we will compensate for it where it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
We are not liable for damage caused by a third party's criminal act (such as unauthorized access, harmful programs, impersonation, theft of a device, takeover of an Apple or Google account, or external attacks on the facilities of our service providers (limited to cases where the service provider acted without intent or negligence)) where we had taken reasonable security measures and the damage is not due to Our Fault.
We are not liable for damage caused by a User's inadequate management of their device or account (such as not locking the device, handing it to someone else, modifying the operating system, or having an Apple or Google password leaked), unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
If a leak or similar incident occurs, please help prevent harm by following our instructions.
Article 27 (Data Storage)
The original files you take are saved on your device (inside the app). You can choose in Settings whether to also save them to your camera roll. On our servers, we keep resized photos (2048 px and 512 px on the long side) and videos (including audio). When you sign in (for example, on another device or after reinstalling the app), we restore to that device any of your photos and videos on our servers, together with their Spots and Posts (captions, stars and photo order), that are not already on it, with no limit on the number of items, starting with the newest. Restored photos are the resized versions (2048 px on the long side), and restored videos are the versions kept on our servers. Full-size photos, and place names that were added only on your device, are not restored. Anything you have deleted, and anything that had not finished uploading to our servers, is not restored either. Restored photos and videos are saved on the device (inside the app) in the same way as the original files you took.
We keep data on our servers appropriately for the periods set out in the Privacy Policy.
Data on your device may be lost if you delete the app or lose your device, among other cases. Guests have no sign-out option (if you sign in with Apple or Google, the Guest's items move to that account; Article 6(4) and (7)). If you delete a Guest account, we also delete the Guest's items on the device (Article 8). Full-size photos can't be restored from our servers (paragraph 1). Please keep your own copies of important photos and videos, for example by saving them to your camera roll.
When you delete a Post, we completely delete it from our servers within 30 days (this is done by a deletion job that runs once a day; the same job also deletes expired Exported Videos created on our servers (Article 13(1)) and unused Guest accounts (Article 6(5))). However, for Users in every region, when you delete something you took, we immediately delete its Capture Point and accuracy from our servers (the photo or video and its record are deleted within 30 days). For Users in every region, we also delete a Spot point from our servers immediately once everything you took at that Spot has been deleted. Anything you have deleted, anything whose retention period has ended, and anything deleted when an account was deleted can't be restored.
We are not liable for damage caused by the loss or corruption of data unless it is due to Our Fault. The same applies to data we deleted in accordance with these Terms (such as under Article 5(1), Article 6(5), Article 8, Article 24, Article 27(4) and Article 30(3)). If it is due to our slight negligence, Article 36 applies. The fact that a User did not keep their own copies of important photos and videos as described in paragraph 3 will be taken into account, in accordance with law, in determining the amount of damages.
Chapter 7 Changes, Interruptions and Termination
Article 28 (Interruptions of the Service)
We may temporarily suspend all or part of the Service in the following cases:
(1) maintenance, inspections or updates of equipment or systems
(2) failures or faults in equipment, systems or communication lines
(3) outages of, or faults in, External Services (cloud, Apple, Google, notification, map and other services)
(4) force majeure, such as earthquakes, typhoons, floods, fires, power outages, epidemics, war, riots or terrorism
(5) when we need to respond to a security problem, such as unauthorized access, and stop further harm
(6) when required by law or by an order of a court or government authority
(7) any other unavoidable reason similar to the above
When we suspend the Service, we will announce it in the app or on our website in advance (or, in an emergency, promptly after suspending it).
We are not liable for damage caused by interruptions of the Service unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
Article 29 (Changes to Features)
We may add, change or end features of the Service for reasons such as those listed in Article 4(2).
We will announce changes that significantly disadvantage Users (such as ending a main feature), and changes to Location Features that are unfavorable to Users and important changes to them, in the app and on our website at least 30 days before the change. In that case, you can leave at any time free of charge, and you will have a chance to save your photos, videos and other content before you leave.
We are not liable for damage caused by changes to features unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
Article 30 (Ending the Service)
If we end the entire Service, we will announce it in the app and on our website (and by email if you have registered one) at least 30 days before the end date. However, if we cannot give 30 days' notice because of the law, an order of a court or government authority, a serious security risk that threatens Users' safety, or the end of an External Service or other circumstances beyond our reasonable control, we will announce it as early as we can and explain why.
From the date we announce the end until the end date (or, in the case of the proviso to the preceding paragraph, until 30 days after the end date), we will let Users export their own photos, videos and Posts (including captions, stars, and Spot names and times) stored on our servers, free of charge, in a commonly used, machine-readable format (JPEG for photos, MP4 for videos and JSON for everything else). We will also let you save the original files on your device to your camera roll in bulk from the app until the end date.
After the period in the preceding paragraph, we will delete Users' data within 90 days [TO CONFIRM: period] (except data we must keep by law).
We are not liable for damage caused by ending the Service unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
Chapter 8 Liability
Article 31 (Basic Principles of Liability)
These Terms do not limit any liability that can't be limited under the laws of the country or region where you live. Nothing in these Terms restricts your rights under the law (including your rights as a consumer) in a way that law does not allow.
These Terms neither exclude nor limit our liability (including that of our representatives and the persons we employ or engage, including those we use to provide the Service) for intent or gross negligence.
Provisions in these Terms stating that we are "not liable unless it is due to Our Fault" or similar confirm that we are not liable where the damage is not due to Our Fault. Where it is due to Our Fault, our liability is governed by Article 36.
For users in the Republic of Korea, in the EEA, UK and Switzerland, and in the United States, Articles 60 to 62 apply in preference to this Chapter.
We are not liable for damage caused by force majeure, such as natural disasters, fires, power outages, war or epidemics, or for damage caused by a User's failure to follow the precautions or prohibitions in these Terms, unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
If you learn that damage has arisen, or may arise, in connection with the Service, please tell us promptly and take reasonable steps to keep the damage from spreading, such as using the Service's features (Ghost mode, blocking, removing friends, deleting Posts, reporting and so on) and, where necessary, consulting the police or other authorities. If your failure to follow the precautions in these Terms (such as Article 12(2), Article 27(3) and Article 34(2)) or to take these steps caused or increased the damage, this will be taken into account, in accordance with law (including the rules on comparative negligence), in determining the amount of damages we pay.
Article 32 (Warranties)
We provide the Service as described in these Terms (including Chapter 10) and the in-app explanations. The Privacy Policy explains how we handle personal information (Article 1(4)); it does not add to our contractual obligations beyond those in these Terms. This paragraph does not change any obligation we have under the law.
If we become aware that the Service has a defect that differs from these Terms or the in-app explanations (that is, it does not conform to the contract), we will fix it within a reasonable period or guide you to an alternative.
The Service is provided free of charge and is an app we keep improving. How it works can vary depending on your device, operating system, network environment and External Services. We do not promise that the Service will suit your particular purpose, that you will get the results you expect (such as the people you were with always being detected, or Exported Videos being treated in a particular way on external social networks), or that it will keep running without interruptions or defects.
The preceding paragraph does not release us from liability under Article 36.
Article 33 (Disputes Between Users)
You are responsible for your communications, meetings and other interactions with other Users. If a dispute arises between Users, please resolve it among yourselves. We will provide the necessary cooperation, such as taking measures under these Terms and providing information in accordance with the law.
Where necessary, such as when we receive a report, we will make efforts to take measures under these Terms (including hiding Posts, restricting features, suspending accounts, and consulting with and providing information to the police or other authorities).
We are not liable for damage caused by the conduct of other Users or third parties (including following, lying in wait, stalking, harassment, impersonation, publication without consent, and friends saving, forwarding or taking screenshots) unless it is due to Our Fault. Cases where, through our intent or negligence, a mechanism we described in these Terms or the Privacy Policy (such as Ghost mode or blocking) did not work as described, and cases where we failed to respond to a report without a legitimate reason, are cases of Our Fault. If it is due to our slight negligence, Article 36 applies.
As stated in Article 12(3), the Service is not intended for watching over people, crime prevention, emergency reporting or checking that people are safe.
Article 34 (Accuracy of Location, Detection, Maps and AI)
The Service is provided on the basis that it has the following characteristics. We do not promise that locations, the results of Together detection, Friends nearby and People nearby, map and place information, or AI results are accurate or complete.
(1) Location Information is obtained through your device's positioning (GPS, Wi-Fi and mobile network base stations), so indoors, underground, near tall buildings, and depending on signal conditions and your device's operating system and settings (for example, if "Precise Location" is off), it may be off by tens of meters or more, delayed, or unavailable.
(2) The results of Together detection, Friends nearby and People nearby are estimates based on Location Information. People who were with you may be left out, and people who weren't with you may be included. Friends nearby and People nearby may not be shown to you, for example, right after you make a large move (Article 55(1), item 3).
(3) Place names, categories, addresses and map data (from OpenStreetMap, Community Places, Google, Kakao, Apple and other sources) may be wrong or out of date.
(4) Categories and specific types (in Japanese, Korean and English) determined by AI may be wrong.
(5) Routes and directions drawn on the map are there to show your records, and may differ from the route actually taken. The distinction between walking and traveling by vehicle (including "On the move" and "In the sky") may also be wrong.
Do not use the Service to check that people are safe, for emergency communications, for route guidance, to track people, or as legal proof (such as proof that you were in a certain place at a certain time).
You can correct results by removing someone from the people you were with, re-selecting place names, reporting errors and so on.
We are not liable for damage resulting from the characteristics in the preceding paragraphs, or for damage resulting from decisions made or actions taken by Users based on Location Information (such as meeting up, traveling or meeting people), unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
Article 35 (External Services)
The Service uses External Services (Apple's sign-in, notifications, place name and address search and App Store; Google's sign-in and Places API; notifications from 650 Industries, Inc. (Expo); cloud services from Supabase and Cloudflare (including map tile delivery and Workers AI); OpenStreetMap data and OpenFreeMap (for map text, and as the source our servers fetch maps from for areas outside Japan and the Republic of Korea and similar cases); Kakao search; usage analytics from PostHog and Google (Google Analytics for Firebase); and others). The providers we entrust with handling data are listed in the Privacy Policy. We choose these providers appropriately and supervise them as necessary.
When you use External Services, their terms and privacy policies may apply in addition to these Terms.
If External Services stop or change, parts of the Service may become unavailable. We are not liable for damage caused by failures of or changes to External Services or telecommunications carriers' lines, changes to or defects in the specifications of your device's operating system (including changes to how location information is handled), or changes to App Store or similar review processes or policies, unless it is due to Our Fault. If it is due to our slight negligence, Article 36 applies.
External social networks (such as TikTok and Instagram) where you yourself share Posts or Exported Videos are not our service providers. How shared content is handled is governed by Article 13(6).
Article 36 (Scope and Cap of Our Liability)
If we cause damage to you through a breach of our obligations or a tort, we will compensate you in accordance with the law and this Article.
If the damage is caused by slight negligence (meaning negligence other than gross negligence; the same applies below) on our part (including that of our representatives and the persons we employ or engage, including those we use to provide the Service; the same applies in the next paragraph), the damage we compensate is limited to ordinary and direct damage you actually suffered, and does not include damage arising from special circumstances (including where we foresaw or could have foreseen those circumstances) or lost profits (profits you would otherwise have earned). The amount is capped at whichever is higher: the amount you paid us in the 12 months before the date on which the event that caused the damage occurred, or JPY 10,000. All damage suffered by one User from the same cause (including a series of related events) is compensated together within this cap, whether the claim is based on breach of obligations or tort and regardless of the number of claims. This cap has been set in light of the fact that the Service is provided free of charge (Article 17(1)).
The preceding paragraph does not apply where the damage is caused by intent or gross negligence on our part. In that case, we will compensate for the damage in accordance with the law.
Paragraph 2 does not apply to damage resulting from harm to a person's life, body or health. "Harm to health" here means a medically recognized physical or mental injury or illness, and does not include mental distress itself (the kind compensated by damages for emotional suffering) caused by an invasion of privacy or a leak of information (paragraph 2 applies to damage from such distress, except in cases falling under the preceding paragraph). The preceding paragraph and this paragraph provide that paragraph 2 (both the limitation on the scope of damage and the cap) does not apply where we are liable under the law; they do not create any new liability on our part. Whether we are liable is determined by the law and the other provisions of these Terms (including Article 31(3), (5) and (6), and Articles 33 to 35).
How this Article applies to users in the Republic of Korea, in the EEA, UK and Switzerland, and in the United States is set out in Articles 60 to 62.
Article 37 (Your Liability)
If you breach these Terms for a reason attributable to you and cause damage to us, or cause damage to us intentionally or negligently, you will compensate us for that damage.
If, for a reason attributable to you, we receive a claim from a third party (including another User) concerning your Posts or your breach of these Terms or the law, you will resolve it at your own responsibility and expense, and reimburse us for reasonable amounts we have paid (including damages, amounts paid in a reasonable settlement we made after notifying you, and reasonable attorneys' fees).
If you cause damage to other Users or third parties through your use of the Service, you are responsible for it.
Chapter 9 General Provisions
Article 38 (Notices and Contact)
We send notices to you using whichever of the following suits the content: in-app notices, notifications, email (if you have registered one), or posting on our website. We also send important notices to you individually in the app.
You can contact us through Contact us in the app or at contact@ideaccept.com. You can contact us in Japanese, Korean or English.
Article 39 (Assignment of Rights and Obligations; Transfer of Business)
You may not transfer or pledge your position under these Terms, or your rights and obligations under these Terms, to anyone else without our prior written consent (which may be given electronically).
If we transfer the business of the Service to another company (including by business transfer, company split or merger), we may transfer to the transferee our position under these Terms, our rights and obligations under these Terms, and Users' information.
In that case, we will notify you in advance, for example in the app. You can leave at any time. We will transfer Users' information in accordance with the Privacy Policy and the law, and only to a transferee that has promised to protect the information to the same standard as these Terms and the Privacy Policy.
Article 40 (Severability)
Even if any provision of these Terms, or any part of one, is held invalid or unenforceable under the law or by a court, the other provisions and the rest of that provision remain in effect. If a provision is held invalid or unenforceable only in relation to a particular User or only in particular circumstances, it remains in effect in relation to other Users and in other circumstances. Any part held invalid or unenforceable is replaced by the applicable provisions of the law (for US Users, Article 62(17) applies).
Article 41 (Language and Authoritative Version)
The Japanese version of these Terms is the authoritative version. However, in relation to Users who habitually reside in the Republic of Korea (Korean Users under Article 60), the Korean version is the authoritative version.
The English version and versions in other languages are translations provided to help you understand these Terms. If a translation differs from the authoritative version, the authoritative version under the preceding paragraph prevails.
Article 42 (Governing Law and Jurisdiction)
If questions arise about how to interpret these Terms, or about matters these Terms don't cover, you and we will try to resolve them through good-faith discussion.
These Terms are governed by the laws of Japan.
The Tokyo District Court or the Tokyo Summary Court, depending on the amount in dispute, has exclusive agreed jurisdiction as the court of first instance over any dispute relating to these Terms or the Service.
The preceding two paragraphs do not prevent a User who is a consumer habitually residing outside Japan from receiving protection under the mandatory laws of the country or region where they habitually reside (laws that protect consumers and can't be changed by contract), or from bringing an action in the courts of that country or region as permitted by law. For users in the Republic of Korea, in the EEA, UK and Switzerland, and in the United States, Articles 60 to 62 prevail.
Chapter 10 Location Information
Article 43 (Purpose and Status of This Chapter)
This Chapter sets out the rights, obligations and responsibilities of us and Users, as Personal Location Information Subjects, and other necessary matters, concerning how we collect and use Users' Location Information in the Service and show it to other people, and the conditions for using Location Features.
Where this Chapter and the other Chapters of these Terms (excluding Chapter 11) differ on how Location Information is handled, this Chapter prevails. However, Chapters 8 and 9 prevail as to the scope and amount of damages, governing law, jurisdiction and the method of resolving disputes. The regional terms in Chapter 11 also prevail over this Chapter for the users they apply to.
In relation to Korean Users, this Chapter, Article 60 (Users in the Republic of Korea) and the provisions of these Terms that they refer to constitute the terms and conditions for location-based services (위치기반서비스 이용약관) under Articles 12 and 19 of the Location Information Act. We obtain consent to these terms and conditions as Location Consent (Article 3(2)), through a checkbox separate from the one for agreeing to these Terms [TO CONFIRM: Korean counsel (consolidating the location chapter into the Terms)].
Handling of Location Information not covered by this Chapter is governed by the other Chapters of these Terms and by the laws that apply to the User (such as Japan's Act on the Protection of Personal Information (the "APPI") and Telecommunications Business Act; the Republic of Korea's Location Information Act, Personal Information Protection Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. and Telecommunications Business Act; and the EU General Data Protection Regulation (GDPR)).
If the explanations of Location Information in this Chapter and in the Privacy Policy conflict, this Chapter applies, and we will correct the Privacy Policy.
In this Chapter, "Korean Users", "EEA/UK/Swiss Users" and "US Users" mean the users defined in Article 60(1), Article 61(1) and Article 62(1), respectively.
Article 44 (What the Location Features Include)
We use Location Information to provide the features in the table below.
Feature Location Information used Purpose Required or optional Map and current location Your location while the app is open Show on the map where you are and the name of the place you're in Needed for this feature (Location Consent) Spot recording Capture Point, Spot point, your speed and altitude when you take a photo (used only on your device and not sent) Attach the place name, category, map point and time to the photos and videos you take, so you can look back on them in your Log, on the map and in exports. If you take a photo while in a vehicle (30 km/h or more), use the name of the area and the category "On the move" instead of a shop name (at 200 km/h or more, or at an altitude of 3,000 m or more, the place name "In the sky" and the category "Flight") Needed for this feature (Location Consent) Place name suggestions and search Current Location, Capture Point Suggest names of nearby shops and facilities. Search nearby when you choose a different name Needed for this feature (Location Consent; searches run only when you start them) Walked route Your location while the app is open (and, if you allow "Always", while it is closed (even after it has been quit)). Motion records (for people who allow Motion & Fitness; only on your device) Show the route you actually walked on the map in your Log and exports (distinguishing between walking and traveling by vehicle, and fitting the route to the roads and railways in the map tiles). Recorded even during Ghost mode. Used only on your device and not sent to our servers Needed for this feature (Location Consent; used only on your device. Motion & Fitness permission is optional) Together detection Location of the person taking the photo, friends' Current Locations Estimate and record which friends were with you when you took a photo, and notify them Required (all Users; consent to the provision of Personal Location Information to third parties; Article 3(1), item 4 and Article 3(4); for EEA/UK/Swiss Users, the legal basis is performance of a contract; Article 61(17)) Showing your Posts to friends Spot point Show friends your Posts (for 36 hours after you first take a photo at that Spot) and your photo pins on the Map Required (all Users; consent to the provision of Personal Location Information to third parties; Article 3(1), item 4 and Article 3(4); for EEA/UK/Swiss Users, the legal basis is performance of a contract; Article 61(17)) Friends nearby Current Location Show friends within about 300 m, with their profile photo and name and whether they are "together" Required (all Users; consent to the provision of Personal Location Information to third parties; Article 3(1), item 4 and Article 3(4); for EEA/UK/Swiss Users, the legal basis is performance of a contract; Article 61(17)) "Always" location Your location while the app is closed (even after it has been quit) (the app is woken by iOS's "significant location change" and "visit" notifications, and while you are moving, GPS records your location about every 15 m; includes the arrival and departure times at places you visit) Keep your Current Location up to date so that Together detection works even when friends have the app closed. Record your walked route. Show you in Friends nearby and People nearby (the latter only if "Show me to people nearby" is on) for up to 60 minutes after your last location, even while the app is closed Optional (off by default) People nearby Current Location Show Users within about 50 m of each other their profile photo, display name and ID, to make it easier to add friends Optional (on by default for people aged 18 or older (19 or older in the Republic of Korea), wherever they live, and can be turned off in Settings (Article 11(7), item 1); not available to minors (under 18 in Japan and most other regions, and under 19 in the Republic of Korea)) Hiding the area around your Home Home location Leave the area around your Home out of what friends see (the "Hide my home on friends' map" setting; on by default), Community Places and exports (the "Hide my home" setting for exports; on by default; it can be turned off only for the "Map on top" layout, and your Home is always hidden in the "Photo on top" layout; the areas around the Homes of friends you were with are always hidden) Optional (for people who have set a Home; hiding from what friends see can be turned off in Settings, and hiding your own Home in exports can be turned off in Settings only for the "Map on top" layout) Community Places Spot point When you choose or enter a name for a place that isn't on the map and take a photo there, add that place to everyone's map. The place name is sent to AI, which decides the category and the more specific type (in Japanese, Korean and English). The place name is not translated by AI; it is shown in Japanese, Korean and English using the name suggestions from place search. For Users who have given permission, a photo taken with the rear camera (photos taken with the front camera are not sent) is also reduced to 512 px on the long side, stripped of location and other metadata, sent to AI and used only to decide the category (we don't store it; we ask once before sending a photo for the first time and send photos only if you allow it, and you can withdraw this at any time in Settings; Article 14(2)) When you choose or enter a name for a place that isn't on the map and take a photo there (places are not added near your Home, while you are in Ghost mode, or from Spots taken in Ghost mode; Article 15(5)) Export Spot points, walked route, Spot points of friends who were with you, motion records (for people who allow Motion & Fitness; only on your device) Turn Logs and Posts into map videos and images. Created on your device Optional (when you create one) Notifications and Lock Screen Place names (coordinates are not used) Let you know about things such as photos taken together. Show the name of the place you're in on the Lock Screen Optional (can be turned off in Settings; Live Activities are on by default) The Service is not a "location sharing" service that continuously shows friends' Current Locations on a map. All that friends can see are the Spots of the Posts you took and the results "was together" and "is nearby". Your Current Location (coordinates) is never shown to anyone, including friends (Article 47).
The Service is not a service for watching over people, crime prevention, emergency calls, checking that people are safe, navigation (route guidance), or finding or following where people are (Article 12(3)). Do not use it for these purposes. Who to contact in an emergency is set out in Article 12(2), item 7.
Some Location Features may not be available depending on your device's operating system, your location permission settings ("While Using the App", "Always", "Precise Location") and network conditions. While location permission is not given, features that use your own location are unavailable (Article 10(2)).
Article 45 (How We Collect Location Information)
Through the Maplog app, we receive the location measured by the location services of your device's operating system (such as iOS) using GPS, Wi-Fi, mobile network base stations and so on. We do not measure locations ourselves using our own positioning equipment.
We ask your device's operating system for location permission only after we have obtained Location Consent on a screen in the app. We do not treat OS permission alone as Location Consent.
We receive your location in the following cases:
(1) While the app is open: with high accuracy, when you move about 10 m or every 15 seconds. The location we receive is sent to our servers as your Current Location (overwriting the previous one).
(2) If you allow "Always": also while the app is closed (even after it has been quit), the app is woken by iOS's "significant location change" and "visit" notifications. While you are moving, we receive your location in detail with GPS (about every 15 m), and we stop receiving it when you stop moving. For places you visit, we also record the arrival and departure times. Only your single latest Current Location is sent to our servers; everything else goes only into the walked route on your device. We record your location while the app is closed only while you are signed in (recording stops when you sign out or delete your account, and does not resume until you sign in again).
(3) When you take a photo: we record your location at that moment as the Capture Point and the Spot point.
(4) When a feature needs it, such as when you open the People nearby screen or choose "Set my current location as home".
"Always" is optional. Even if you do not allow "Always", every feature that works while the app is open is available to you. We do not repeatedly ask people who have not chosen "Always". Right after you allow "While Using the App", your device's operating system may ask whether to change to "Always", and you can also choose to stay on "While Using the App" there.
You set your Home either by choosing "Set my current location as home" or by entering an address. Turning an address into a point on the map is done by your device's operating system (Apple), and we do not store the text of the address. Your Home location is stored rounded to a grid of about 100 m (Article 55(1), item 4).
While Ghost mode is on, we do not send your Current Location to our servers, even while the app is open. When you turn Ghost mode on, we delete your Current Location from our servers. Our servers also do not record any location while Ghost mode is on, and delete any location that remains. Your location when you take a photo is still recorded during Ghost mode, as described in paragraph 3(3) (it is not shown to friends; Article 53(2)). Your walked route is also recorded on your device during Ghost mode (it is not sent to our servers).
Your walked route, the cache of found routes (the coordinates of both ends of each section for which a route was drawn, and the shape of the route) and the places you have re-selected yourself (up to 300) are recorded only on your device and are not sent to our servers. For people who allow "Motion & Fitness", to identify the parts of the walked route traveled by vehicle, the app reads, on your device, the types of activity recorded by your iPhone (stationary, walking, running, cycling, in a vehicle) and how confident each is, only for the time between places in your own Log. What is read is also used only on your device and is not sent to our servers or to usage analytics.
Photos (resized to 2048 px and 512 px on the long side) and videos are sent to our servers after location and other information (metadata) has been removed. The original files you took are stored on your device (in the app). When you sign in on another device or in similar cases, we restore the resized photos (2048 px on the long side) and videos on our servers to that device, together with their Spot points and Capture Points (full-size photos are not restored; Article 27(1)).
This Article applies in the same way when you use the Service as a Guest. When we move a Guest account's items to the account you signed in to (Article 6(4)), we also move Spot points, Capture Points, observations of whether you were together and similar items, but this is a transfer between your own accounts, not a provision to other Users.
Positioning results contain errors (Article 34(1), item 1).
Article 46 (Purposes of Use)
We use Personal Location Information only for the following purposes:
(1) to show on the map where you are and the name of the place
(2) to record the Spot and time of the photos and videos you take, so you can look back on them in your Log, on the map and in exports
(3) to suggest names of nearby shops and facilities, and to search nearby when you choose a different name
(4) to perform Together detection, and to record and notify the people you were with
(5) to show your Posts and Spots to friends, and to show Friends nearby
(6) to show People nearby (only for people who have "Show me to people nearby" turned on)
(7) to leave the area around your Home out of what friends see, Community Places and exports (except where you have turned off hiding from what friends see in Settings, or have turned off hiding your own Home in exports in Settings for the "Map on top" layout; exports in the "Photo on top" layout and the areas around the Homes of friends you were with are always left out)
(8) to add Community Places to the map
(9) to record how long you were together and when you met up and parted, and to show this in Logs and videos (using records that do not include coordinates)
(10) to show place names in notifications and in Live Activities on the Lock Screen
(11) to prevent misuse such as location spoofing and stalking, to respond to reports, and to protect Users' safety (including using the Location Disclosure Records to handle complaints and investigate misuse; we do not create any new location history for this purpose)
(12) to keep the Location Disclosure Records, to meet our legal obligations, and to respond when Users exercise their rights
We do not use Personal Location Information for advertising, for sale or for credit assessment. Nor do we analyze Users' hobbies and interests for use in advertising or assessments (profiling). We also do not infer sensitive matters such as health, religious beliefs or sex life from Spot categories or similar information.
We do not send locations, place names, photos or photo URLs to usage analytics services. What we send for analytics, how we obtain consent (in every country and region, data is sent only if you consent) and how to withdraw it are set out in Article 3(4) and Article 25(3).
Article 47 (Provision to Other Users)
Within the scope you have agreed to (for EEA/UK/Swiss Users, as performance of a contract, as described in Article 61(17)), we provide Personal Location Information (or information that can be derived from it) to other Users as shown in the table below.

Together detection, Friends nearby and People nearby are determined only on our servers, and all that is returned to other Users is IDs, profile photos, names and the results "was together" and "is nearby".
People who are not your friends cannot see any information relating to your location, except through People nearby (if "Show me to people nearby" is on) and Community Places (which do not show who added them). Who can see other Users on the People nearby screen is set out in Article 11(7), item 5.
We do not provide Personal Location Information to other Users beyond the recipients and the scope of information that Users have agreed to.
How your Posts and Spots are handled while you are in Ghost mode and around your Home is set out in Article 11(3); how Together detection works, in Article 11(4); notifications and Live Activities, in Article 16; Exported Videos, in Articles 13 and 20; and Community Places and sending data to AI, in Article 14 and Article 15(5).
We cannot technically prevent, in every case, other Users from taking information provided to them outside the Service by screenshots, saving, forwarding and so on. Doing so is prohibited (Article 23, items 1 and 12). Our liability for damage caused by such conduct is governed by Article 33(3).

Maps outside Japan and the Republic of Korea, zoomed-out maps (below zoom level 6) and maps that cross the boundaries of our map data coverage (each region of Japan, and the Republic of Korea) are relayed by our servers, which send only the tile numbers (your IP address is not sent) Displaying map text; relaying maps outside Japan and the Republic of Korea and similar maps (the map data is OpenStreetMap) We enter into contracts with the service providers we entrust information to, and require them to handle it appropriately, for example by not using it for any other purpose and by telling us if a leak or similar incident occurs (how photos sent to AI are handled is set out in Article 14(1)). Where we use public services such as OpenFreeMap, we send only the minimum information needed for display. Map tiles are relayed by our servers, which send only the tile numbers and not your IP address. Map text is fetched directly by your device, so your IP address and the type and range of characters reach the provider, but no location is sent.
The list of our service providers, the grounds for transfers outside the country, and details of the safeguards are set out in the Privacy Policy. How the information we send to Google LLC and Kakao Corp. for place searches is treated under Japanese law is set out in Article 15(2). Usage analytics providers are covered in Article 46(3), and external social networks in Article 35(4).
Article 49 (Limits on Use and Provision)
We do not use Personal Location Information or the Location Disclosure Records, or provide them to others, beyond the purposes set out in this Chapter and the scope that Users have agreed to, except in the following cases (Article 21 of the Location Information Act):
(1) using or providing them, for statistics, academic research or market research, in a form processed so that no specific individual or home can be identified
(2) where another law specifically provides otherwise (provision to investigative authorities is governed by paragraph 3)
We do not sell Personal Location Information. Nor do we provide it to other businesses for advertising.
If an investigative authority asks us to provide Location Information (including Current Locations, Spot points, Capture Points and Home locations), we respond only to the extent necessary and only in compliance with a warrant issued by a judge (in the Republic of Korea, including a court's permission). We do not provide Location Information in response to requests without a warrant (such as investigation inquiries under Japanese law). If the police, fire services or other rescue authorities make a request on the grounds that there is an imminent and serious danger to someone's life or body, we respond in accordance with the law (in Japan, including the Guidelines on the Protection of Personal Information in Telecommunications Business).
Article 50 (The Location Disclosure Records Screen, and Notice of Each Provision)
We will make it possible for all Users to see, on the "Location Disclosure Records" screen in the app, when, to whom and for what purpose we provided their Personal Location Information, for the past year [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)].
For Korean Users, each time we provide your Personal Location Information to another User, we will immediately notify you of the recipient, the date and time of provision and the purpose of provision, through an app notification and the "Location Disclosure Records" screen (Article 19(3) of the Location Information Act) [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)]. We will notify you at the following times:
Provision When we notify you, and what we tell you Showing Posts to friends When a Post becomes visible to friends. We tell you the recipients (a list of the display names and IDs of the friends who can now see the Post), the date and time of provision, and the purpose of provision ("showing friends where you took photos") Recording you as someone who was with another User When someone is recorded through Together detection or otherwise. We tell the person who took the photo who was recorded, and we tell the person recorded who took the photo and the list of people who can see the recorded person's profile photo and name on that Post (people who are friends of the recorded person). The notification that a photo was taken together also serves as this notice Showing you as a friend nearby When you start being shown to a friend [TO CONFIRM: unit of notification] Showing you in People nearby When you are shown on another User's screen (we tell you the display name and ID of that User) Use in a friend's export When a friend who was with you creates a video or image that includes your photos, name and Spots. We tell you the display name and ID of that friend, and that the friend can share the video or image outside the Service The text of these notices states the recipient, the date and time and the purpose, and does not include coordinates. Place names are also not included, except in the notification that a photo was taken together (Article 16(1)). You can see which Post a notice relates to on the "Location Disclosure Records" screen in the app.
If a Korean User gives separate consent, we will combine the notices in the preceding paragraph and send them together every 30 days (Article 19(4) of the Location Information Act). Even after choosing combined notices, you can switch back to immediate notices at any time in the app settings.
We send notices to Korean Users to the device that collected the Personal Location Information (as Maplog app notifications). If notices cannot be received on that device (including where app notifications are not allowed), or if the User has asked in advance for notices to be sent to another device or email address, we send them to the email address or other destination the User has specified in advance. If no destination has been specified, we show the notice in the app as soon as the app is opened and keep it on the "Location Disclosure Records" screen [TO CONFIRM: how to notify users who have not allowed notifications (Location Information Support Center)].
Article 51 (Retention and Use Periods, and Deletion)
We keep Personal Location Information and related data only for the periods below. When the period ends or the purpose has been achieved, we delete the data without delay in a way that cannot be undone. We destroy the Personal Location Information of Korean Users immediately once the purpose has been achieved (Article 23 of the Location Information Act).

This purpose continues until you delete the Post or your account. You can end our retention at any time by deleting the Post [TO CONFIRM: relationship with Article 23 of the Location Information Act (Location Information Support Center and Korean counsel)].
When you delete your account, we immediately delete your Personal Location Information held on our servers (Current Location, Spot points, Capture Points, Home location, records of people you were with, observations of whether you were together, and stored answers for Friends nearby and Together detection). What remains (anything on friends' devices or that friends have saved or shared, anything you have saved to your camera roll or shared on external social networks, data inside the app on other devices (until the app is next opened on that device, or as otherwise described in Article 8(3), item 9), Community Places that other Users also added, records needed for legal compliance and disputes, and backups) is as set out in Article 8(3). The Location Disclosure Records of Korean Users are deleted in accordance with Article 53(6).
Article 52 (Data Confirming the Use and Provision of Location Information)
We will have our systems automatically record and keep the fact that Personal Location Information was collected, used or provided to other Users (the Location Disclosure Records) [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)].
Each record contains the User concerned, the type (collection, use or provision), the recipient (user ID) or the feature used, the date and time, and the method (the feature and how the location was obtained). We do not record the location itself, such as coordinates.
We keep these records under Article 16(2) of the Location Information Act (Republic of Korea) and Article 29 of the APPI (Japan). Our records of provision to third parties for Japan are made using the method in Article 19(3) of the Enforcement Rules of the APPI, consisting of these Terms, each User's consent records and the Location Disclosure Records, and we will keep them for 1 year from the date of the last provision. We will keep the Location Disclosure Records for 1 year from the date of recording [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release; the Japanese records of provision to third parties (Article 29 of the APPI) are also made from these records)].
We manage the Location Disclosure Records so that they cannot be altered, and we do not show them to anyone other than you, except where required by law.
Article 53 (Your Rights Regarding Location Information)
Withdrawing consent: You may at any time withdraw all or part of your consent concerning Location Information (Location Consent, and those of the consents under Article 3(4) that relate to Location Information).
(1) Withdrawing all consent: delete your account.
(2) Provision of Personal Location Information to third parties: you can withdraw this with "Provide my location to third parties" in the app settings (this is the same for Users in every country and region). If you withdraw it, you can no longer use the Service, and when you open the app you will be asked to choose whether to consent again or delete your account (Article 3(4)). While your consent is withdrawn, Together detection, showing your Posts to friends, Friends nearby and People nearby stop, and we don't send your Current Location to our servers.
(3) "Always" location: you can change it to "While Using the App" in the app settings or your device settings.
(4) People nearby: you can turn it off in the app settings.
(5) Combined notices (Republic of Korea): we will let you switch back to immediate notices in the app settings [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)].
(6) Your profile photo and display name appearing in friends' Exported Videos: you can stop this by removing yourself from the people they were with on that Post (Article 20).
Temporary suspension: You may at any time ask us to temporarily stop collecting, using and providing your Personal Location Information, and we will not refuse. Ghost mode is the means we provide for this. While Ghost mode is on:
(1) We do not send your Current Location to our servers, and we delete the Current Location held on our servers.
(2) You are not included in Together detection (and no detection runs when you take a photo).
(3) Your Posts are not shown in friends' Logs or on their Map.
(4) You do not appear in Friends nearby or People nearby.
Even during Ghost mode, the Spot points and Capture Points of the photos and videos you take are stored on our servers as your own records (they are not shown to friends). Your walked route also continues to be recorded on your device (it is not sent to our servers). If you want to stop this collection as well, turn off Maplog's location permission in your device settings. In that case, we do not receive your location, and features that need Location Information will not be available. You may also ask for a temporary suspension by other means, using the methods in paragraph 5, and we will not refuse. If you want to stop Together detection and Friends nearby only with particular friends, turn off "together" for those friends.
Requests for access and notification: You may ask us to show you, or tell you about, the following:
(1) your Personal Location Information
(2) your Location Disclosure Records
(3) the reasons for and details of any provision of your Personal Location Information to other Users
Requests for correction: If the information in the preceding paragraph is wrong, you may ask us to correct it. You can correct Spot names, the people you were with, your Home and so on yourself in the app.
How to exercise your rights, and response times: You can exercise the rights in the preceding paragraphs through the app's settings and features, or by contacting us ("Contact us" in the app, or contact@ideaccept.com). We will respond without delay after confirming your identity (or, if a Legal Guardian or other person makes the request, their authority to do so). We will respond to access requests from Korean Users within 10 days, and to requests from EEA/UK/Swiss Users within 1 month (unless an extension is permitted by law). There is no charge.
Deletion after withdrawal: When all or part of your consent is withdrawn, we delete the Personal Location Information covered by the withdrawn consent without delay and in a way that cannot be undone. For Korean Users, we also delete the Location Disclosure Records covered by the withdrawn consent (Article 24(4) of the Location Information Act). In other regions, we keep records that the law requires us to keep (such as the Location Disclosure Records) for the periods in Article 51. Even if you withdraw your consent to the provision of Personal Location Information to third parties, the Spot points of Posts you took are kept as your own records until you delete those Posts (after withdrawal, they are not shown to other Users).
A Legal Guardian may exercise the rights in this Article (withdrawing consent, temporary suspension, access and notification, correction) on behalf of a minor User. We will respond after confirming that the person is the User's Legal Guardian. The conditions for minors' use and the restrictions on People nearby are set out in Article 5, and how children under 14 and children aged 8 or under, etc. in the Republic of Korea are treated is set out in Article 60(10) and (22).
Article 54 (Precautions and Prohibited Conduct When Using Location Information)
Precautions for using Location Features safely are set out in Article 12(2), prohibited conduct in Article 23, and measures against violations in Article 24.
Collecting, using or providing another person's location without their consent may be a criminal offense under the laws of various countries, such as Japan's Act on the Regulation of Stalking Behavior, etc., and the Republic of Korea's Location Information Act and Act on the Punishment of Stalking Crimes.
Article 55 (Measures to Protect Location Information)
To protect Personal Location Information, we take the following measures in addition to those in Article 26(1), items 2 to 5:
(1) We keep only the single latest Current Location on our servers, and delete it if it is not updated for 24 hours. Walked routes are not sent to our servers.
(2) Together detection, Friends nearby and People nearby are determined only on our servers, and coordinates, distance and direction are not returned to other Users. The functions that make these determinations do not accept coordinates from the caller and use only the caller's own Current Location held on our servers.
(3) We accept locations only through our own functions (not even you can write them directly). We do not accept values that are out of range, locations sent less than 5 seconds after the previous one, or locations further from the previous location than is possible at a speed of about 70 m per second, and we record no location while Ghost mode is on. We use our servers' time. To reduce the use of fake locations to find out where other people are, we do not return People nearby or Friends nearby to a user right after they make a large move (for about 2 minutes, or about 30 seconds if they had not sent their location for a while), or when they have no previous location, such as right after their location is first placed or right after they turn off Ghost mode (for about 30 seconds). People nearby can be used at most once every 30 seconds; for 10 seconds after an answer, Friends nearby returns the previous answer; and for each friend, we limit how many times they can appear in, disappear from or change "together" status in Friends nearby (12 times an hour in total) and how many times the Together detection result for them can change (20 times an hour). Together detection can be run at most 60 times an hour, and is centered on the user's own latest location held on our servers, not on the Capture Point. Friends nearby and People nearby are listed in order of name, not distance. Rate-limit records and stored answers (Article 51(1)) are kept where not even you can read or write them.
(4) We leave the area around your Home (about 400 m) out of Community Places. We also leave it out of what friends see, and hide the map in exports (both by default. We stop leaving it out of what friends see only if you turn that off in Settings. We stop hiding your own Home in exports only if you turn that off in Settings for the "Map on top" layout; in the "Photo on top" layout, it is always hidden. The areas around the Homes of friends you were with are always hidden in exports). Your Home location is stored rounded to a grid of about 100 m, and only you can read it.
(5) With people you have blocked, we stop Together detection, Friends nearby, People nearby, friend requests and the showing of Posts entirely.
(6) Users, Posts and comments can be reported, and we will review reports within 24 hours (except where circumstances beyond our reasonable control prevent this).
(7) We will automatically keep the Location Disclosure Records (Article 52) and use them to investigate misuse [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)].
(8) You can check and change whether "Show me to people nearby" is on at any time in the app settings.
(9) We have internal procedures for handling Location Information, train the people who handle it, and review our handling regularly.
(10) We make Capture Points and their accuracy unreadable by anyone other than you (friends can see only Spot points).
Our response to, and liability for, a leak, loss, damage or similar incident involving Personal Location Information (including where one may have occurred) are set out in Article 26.
Our servers can't verify whether a location sent from a device is genuine. For this reason, the measures in paragraph 1, item 3 reduce, but can't completely prevent, the use of fake locations to find out whether other Users are in a particular area. We are not liable for damage caused by other Users' use of fake locations unless it is due to Our Fault. Cases where, through our intent or negligence, the measures in this Article did not work as described are cases of Our Fault (Article 33(3)). If it is due to our slight negligence, Article 36 applies.
Article 56 (Location Information Manager)
To properly manage and protect Personal Location Information and to handle Users' complaints promptly, we have designated a Location Information Manager. The Location Information Manager may also serve as our Chief Privacy Officer.
Location Information Manager: Kaito Asano, Representative Director (contact: contact@ideaccept.com, +81-90-3817-3997; we accept enquiries in Korean)
Complaints: "Contact us" in the app, or contact@ideaccept.com. We accept complaints in Japanese, Korean and English.
The name, address, representative and contact details of the business that provides Location Features (us), and our location-based service business report (Republic of Korea), are shown in "Operator" at the end of these Terms.
Article 57 (Liability and Disputes Concerning Location Information)
Our liability in connection with Location Features is set out in Chapter 8 and in Article 5(4) (misrepresenting age), Article 26 (leaks and similar incidents) and Article 55(3) (false locations) (errors in locations and detection in Article 34, other Users' conduct in Article 33, External Services in Article 35, force majeure and similar events in Article 31(5), and the scope and cap of damages in Article 36). Your liability is set out in Article 37. Article 60 (in particular paragraphs 5 to 8) applies to Korean Users, Article 61 to EEA/UK/Swiss Users, and Article 62 to US Users.
We will discuss in good faith and work to resolve any complaint or dispute concerning Location Information. Governing law and jurisdiction are set out in Article 42 and Chapter 11, and the contact points for consultation and mediation are set out in Article 59(10) for Japan, Article 60(15) for the Republic of Korea and Article 61(19) for the EEA, UK and Switzerland.
Chapter 11 Regional Terms
Article 58 (Application of the Regional Terms)
We distribute the Service only through app stores (such as the App Store) in Japan, the Republic of Korea, the United States, the United Kingdom, Switzerland and the countries of the European Economic Area (EEA), and we do not distribute it through app stores in any other country or region. The regional terms in this Chapter apply according to the country or region where you habitually reside. We determine this from what you tell us, your App Store country or region, your device's region setting and so on. However, this does not prevent you from receiving protection under the laws of the country or region where you actually live.
Where the regional terms in this Chapter differ from other provisions of these Terms, the regional terms prevail.
Article 63 applies to all Users who obtained the Service's app from the App Store, wherever they live.
Article 59 (Users in Japan)
For users who live in Japan, Chapters 1 to 10 (including Article 36) apply as written. In accordance with the Consumer Contract Act, the liability provisions of these Terms neither exclude nor limit our liability for intent or gross negligence.
We protect the secrecy of communications under the Telecommunications Business Act [TO CONFIRM: whether notification as a telecommunications business is required, and the notification number if notified]. Records of who was together with whom, and the content of Posts visible only to friends, are handled as set out in Article 25(4). We publish in the "External transmissions" section of the Privacy Policy what information we send from Users' devices to outside parties (external transmission; for example, when fetching map tiles and map text, looking up place names and addresses, and for usage analytics), where we send it and why.
Notices of rights infringement and requests for disclosure of sender information are handled under Article 22 and the Information Distribution Platform Act.
Matters concerning retained personal data (purposes of use, procedures for requests for disclosure, etc.) are published in the Privacy Policy.
If we introduce paid features, we will provide the disclosures required under the Act on Specified Commercial Transactions.
Location Consent (Article 3(2)) includes consent to the acquisition and use of Location Information under the Guidelines on the Protection of Personal Information in Telecommunications Business. We obtain this consent in advance through a [Required] checkbox separate from your agreement to these Terms (Article 3(1), item 3). For "Always" location, we obtain separate consent (Article 3(4)).
Consent to the provision of Personal Location Information to third parties (Article 3(1), item 4 and Article 3(4); consent to the provision of information to friends, people you were with and Friends nearby under Article 47) is the individual's consent to provision to third parties under Article 27(1) of the APPI and consent to the provision of location information to third parties under the same Guidelines, and we obtain it before any provision through a [Required] checkbox separate from your agreement to these Terms. Because being shown in People nearby is on by default for Users aged 18 or older, the note for this checkbox tells you that you may also be shown in People nearby, that it is on by default, and what others will see (your profile photo, name and ID), and we obtain your consent to it with the same checkbox (you can turn it off at any time with "Show me to people nearby" in Settings). Your profile photo and display name appearing in Exported Videos made by friends you were with (Article 20) is part of the provision to people you were with, and is covered by the consent given with this checkbox.
If a friend is outside Japan (for example, in the Republic of Korea), your Posts and Spots, the fact that you were together, and the fact that you are nearby are shown on that friend's device. This may constitute provision to a third party in a foreign country (Article 28 of the APPI). The note for the checkbox for consent to the provision of Personal Location Information to third parties tells you that being shown to a friend in another country is a transfer to that country, and we show the following in the Privacy Policy:
(1) that we cannot identify the country, because which country a friend is in is not known at the time of consent (the most likely country is the Republic of Korea)
(2) information from the Personal Information Protection Commission about foreign personal information protection systems (we link to it in the Privacy Policy)
(3) that, because the recipients are individuals, we cannot promise to have them take measures to protect personal information
Under the APPI, Users may request disclosure of records of provision to third parties (Article 52(3)) (using the methods in Article 53(5)).
Users who live in Japan can consult the following about Location Information and personal information [TO CONFIRM: contact details]:
(1) the Personal Information Protection Commission's "APPI Consultation Dial" (個人情報保護法相談ダイヤル; +81-3-6457-9849)
(2) the Ministry of Internal Affairs and Communications' "Telecommunications Consumer Consultation Center" (電気通信消費者相談センター)
(3) the Consumer Hotline (188)
Article 60 (Users in the Republic of Korea)
This Article applies to Users who habitually reside in the Republic of Korea ("Korean Users").
We show the important content of these Terms in bold, explain it to Korean Users if they ask, and provide a copy of these Terms on request (Article 3 of the Act on the Regulation of Terms and Conditions). The important content includes at least the following.
(1) The scope of our liability (the cap for slight negligence and its exceptions, and cases where we are not liable; Article 36 and paragraphs 5 to 8 of this Article)
(2) The license to use Posts and how moral rights are handled (Article 18 and paragraph 19 of this Article)
(3) Hiding and deleting Posts, and suspension of use and deletion of accounts (Articles 21 and 24)
(4) Provision of location information (Article 47 and paragraph 4 of this Article)
(5) Your liability and reimbursement (Article 37 and paragraph 7 of this Article)
(6) Changes to these Terms, and that you are deemed to agree if you don't refuse by the effective date (paragraph 9 of this Article)
Location Information is handled in accordance with Chapter 10, this Article and the Location Information Act. Chapter 10 and this Article (and the provisions of these Terms that they refer to) constitute the terms and conditions for location-based services (위치기반서비스 이용약관) under the Location Information Act (Article 43(3)). We have filed a report of location-based service business under Article 9 of the Location Information Act (the report number is shown in "Operator" at the end of these Terms).
As for all Users, we obtain from Korean Users, item by item with separate checkboxes under Article 3(1) (on the sign-in screen or, for Users who were already using the Service, on the one-time confirmation screen), "[Required] Agree to the Terms of Service", "[Required] Agree to the collection and use of personal information" (Articles 15(1)1 and 22 of the Personal Information Protection Act) the consents concerning Location Information in items 1 and 2 below (Articles 18 and 19 of the Location Information Act), and the consent in item 7 (there is also an "Agree to all" checkbox). Items 3 to 6 are handled as described in each item:
(1) [Required] Location Consent (collection and use of Personal Location Information, and consent to the terms and conditions for location-based services; Article 3(2)). We obtain it through a checkbox separate from the one for agreeing to these Terms ("[Required] Agree to the Location-Based Services Terms").
(2) [Required] Consent to the provision of Personal Location Information to third parties (provision to friends, people you were with and Friends nearby; Article 47). As for all Users, providing your location to friends is subject to required consent, because it is essential to the core features of the Service (Together detection, showing your Posts to friends, and Friends nearby). The note on the consent screen shows the recipients and what each of them receives (friends and people you were with: that you were together and where you took the photo (for 36 hours); Friends nearby: that you are within about 300 m; People nearby: your profile photo, name and ID). Among the recipients, "people you were with" and "Friends nearby" are friends that our servers estimate and identify based on location, and these estimates can be wrong (Article 34). You may refuse this consent, but if you don't consent or withdraw your consent, you can't use the Service (when you open the app, you will be asked to choose whether to consent again or delete your account; you can withdraw at any time with "Provide my location to third parties" in Settings) [TO CONFIRM: Korean counsel (the relationship between making provision to third parties required and stopping Users who withdraw, and Article 19(5) of the Location Information Act and Article 22(5) of the Personal Information Protection Act)]. While you have not consented (including after withdrawing), we don't send your Current Location to our servers, and we exclude you from Together detection, showing Posts to friends, Friends nearby and People nearby. Posts and Spots you take while you have not consented are not shown to friends even if you consent later. If a friend is outside the Republic of Korea (for example, in Japan), the information is shown on that friend's device. The note on this consent screen tells you that being shown to a friend in another country is a transfer to that country (the destination country is the country where the friend is; this cannot be identified at the time of consent and is mainly Japan) [TO CONFIRM: whether this is a transfer abroad under Article 28-8 of the Personal Information Protection Act of the Republic of Korea].
(3) Being shown in People nearby (recipients: Maplog Users who open the People nearby screen and whom our servers determine to be within about 50 m of you (we can't completely exclude people who fake their location; Article 55(3)) (Article 47) / items provided: profile photo, display name and ID, and the fact that you are nearby / purpose: adding friends. The note on the consent screen for item 2 tells you that you may also be shown in People nearby and that it is on by default, and we obtain this consent as part of the consent in item 2. If you are 19 or older, "Show me to people nearby" is on by default, and you can turn it off at any time. We will notify you each time you are shown (Article 50) [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)]. While you have not consented to item 2 (including after withdrawing), you can't use the Service, including People nearby)
(4) [Optional] Consent to receiving the notices of each provision combined every 30 days (Article 50(3))
(5) [Optional] "Always" location (collection while the app is closed; used for Together detection and recording your walked route, and to show you in Friends nearby and People nearby for up to 60 minutes after your last location, even while the app is closed). We obtain this not with the checkboxes in paragraph 1, but when you choose "Always" in your device's location permission
(6) Your profile photo and display name appearing, as a person they were with, in Exported Videos and images made by friends who were with you (Article 20) is covered by the consent in item 2 to provision to "people you were with". The friend may share the video or image on external social networks or elsewhere. If you don't want to appear, remove yourself from the people they were with on that Post.
(7) [Optional] Consent to the collection of usage data and its transfer abroad (PostHog, Inc. and Google LLC; United States) (this is the same [Optional] checkbox as for all Users; no location is sent; Article 25(3)). On the consent screen, the recipients are shown by type (external analytics services (USA)), and the details, such as the names and contact details of the recipients, are set out in Section 21.2 (4) of the Privacy Policy. The "Details" link on that checkbox also shows the matters under Article 28-8(2) of the Personal Information Protection Act of the Republic of Korea (the name and contact details of the recipient, when and how the data is transferred, the purpose, the retention period, and how to refuse and the effect of refusing)
Each time we provide your location to friends or others, we will let you know through the "Location Disclosure Records" screen in the app and by notification, as set out in Article 50. However, if you have consented to item (4), we will notify you in a summary every 30 days. [TO CONFIRM: implementation (there is no table for the Location Disclosure Records, no screen for viewing them, and no notice to Korean Users each time their location is provided (or in a summary); in Korea these are obligations under Articles 16(2) and 19(3) of the Location Information Act, so they must be implemented before release)] We ask separately for your consent to sending photos to AI (Workers AI of Cloudflare, Inc. in the United States) (optional; Article 14(2)), not on the sign-in screen but when you first choose a place that isn't on the map. On that screen, we tell you which photo will be sent and the type of recipient (an external image recognition service (USA)), and, under "Details" on that screen, as for all Users, we show the items under Article 28-8(2) of the Personal Information Protection Act of the Republic of Korea (the items transferred, the country to which they are transferred, when and how they are transferred, the name and contact details of the recipient, the recipient's purpose of use and retention period, and how to refuse and what happens if you refuse) (Article 14(2)).
If we cause damage to Korean Users through our intent or negligence, we will compensate for the damage in accordance with the relevant laws and this paragraph. Article 36(2) (the scope of damage and the cap in cases of slight negligence) has been set in light of the fact that the Service is provided free of charge. For Korean Users, only the monetary cap in Article 36(2) (including the provision that damage from the same cause is compensated together within the cap) applies, and the provisions limiting compensation to ordinary and direct damage and excluding damage arising from special circumstances and lost profits do not apply (the scope of damage to be compensated is governed by Article 393 of the Civil Act of the Republic of Korea, including as applied to torts by Article 763 of that Act). However, Article 36(2) does not apply to, and there is no monetary cap on, the following damage:
(1) damage caused by intent or gross negligence on our part (including that of our representatives and the persons we employ or engage, including those we use to provide the Service)
(2) damage resulting from harm to a person's life, body or health (with harm to health meaning, as provided in Article 36(4), a medically recognized physical or mental injury or illness)
(3) damages we owe under the Personal Information Protection Act of the Republic of Korea (including Articles 39 and 39-2), the Location Information Act (including Article 27), the Act on Promotion of Information and Communications Network Utilization and Information Protection, or the Product Liability Act of the Republic of Korea (including damage caused by the leak, loss or damage of personal information or Personal Location Information, and damage caused by provision beyond the scope of consent)
This paragraph sets out the cases in which Article 36(2) (both the limitation on the scope of damage and the cap) does not apply; it does not create any new liability on our part. If we introduce paid features, we will set out and show again how they are treated. [TO CONFIRM: Korean counsel (the monetary cap for slight negligence based on the Service being free, and Articles 6 and 7(2) of the Act on the Regulation of Terms and Conditions)]
For Korean Users, provisions in these Terms stating that we are "not liable unless it is due to Our Fault" or similar mean that "we are not liable unless there is intent or negligence on our part". For Korean Users too, as provided in Article 2, item 22, "the persons we employ or engage" in these Terms includes our performance assistants and employees (including those we use to provide the Service, such as the companies listed in Article 48). Item 4 of paragraph 7 of this Article and Article 35(3) do not exempt us from liability for intent or negligence on the part of our performance assistants (in cases of slight negligence, the cap in paragraph 5 applies).
We are not liable for the following damage unless there is intent or negligence on our part (including, as provided in Article 2, item 22, the persons we employ or engage):
(1) damage caused by force majeure, such as natural disasters, war, power outages or failures of telecommunications carriers' lines
(2) damage caused by reasons attributable to the User (inadequate management of devices or accounts, breaches of these Terms, etc.)
(3) damage caused by disputes between Users, or between a User and a third party
(4) damage caused by failures of External Services
(5) damage caused by positioning errors, Together detection errors or AI errors
(6) damage caused by interruptions for maintenance, inspection or upgrading of equipment that we announced in advance (Article 28)
(7) damage caused by information posted or provided by Users or third parties (including the names of Community Places and map and place information from OpenStreetMap, Google, Kakao and others) being inaccurate or unreliable
(8) damage caused by problems arising from the User's device, operating system or network environment
This paragraph does not change our burden of proving that there was no intent or negligence on our part in the cases described in paragraph 8. If a Korean User breaches these Terms and causes damage to us, we may claim damages from that User. In that case, the User is not released from liability unless they prove that they acted without intent or negligence (Article 37(1)).
If we cause damage to a Korean User by violating any of Articles 15 to 26 of the Location Information Act, we are not released from liability unless we prove that we acted without intent or negligence (Article 27 of the Location Information Act). We do not set any upper limit on the amount of this compensation. These Terms do not limit our liability or Korean Users' rights that cannot be limited under the laws of the Republic of Korea, such as the Personal Information Protection Act of the Republic of Korea (including the burden of proof for damages and statutory damages) and the Location Information Act. For Korean Users, the "reasonable security measures" in Article 26(5) are measured against the technical and administrative safeguards set out in Article 29 of the Personal Information Protection Act of the Republic of Korea and its public notice (the Standards for Measures to Ensure the Safety of Personal Information), and in Article 16 of the Location Information Act and its Enforcement Decree (as stated in this paragraph, the burden of proving that there was no intent or negligence on our part rests with us).
When we change these Terms, we will announce the effective date, the reasons for the change and a comparison of the text before and after the change, in the app and on our website, starting 7 days before the effective date (30 days for changes that are unfavorable to Users and important changes). For unfavorable and important changes, we will also notify you individually, for example by in-app notification. At that time, we will clearly tell you that if you do not indicate that you reject the change by the effective date, you will be deemed to have agreed to it. If a Korean User does not indicate rejection by the effective date, they are deemed to have agreed to the change. Users who reject the change can leave before the effective date (or at any time after it). However, for changes that expand the scope of use or provision of Location Information (purposes, recipients or items provided), we will always obtain consent again instead of relying on deemed consent. For Korean Users, we will change features under Article 29 only where there is a reason listed in the items of Article 4(2) or another equally substantial reason, and we will announce the content and date of the change in the app before the change (or, in urgent cases, promptly after it).
People under 14 cannot use the Service, even with a Legal Guardian's consent. The Service is not intended for people under 14, and because we do not have a mechanism for obtaining and verifying a Legal Guardian's consent for children under 14 (Article 25 of the Location Information Act; Article 22-2 of the Personal Information Protection Act of the Republic of Korea), we do not collect, use or provide the personal information or Personal Location Information of children under 14. We check that you are 14 or older using your date of birth (Article 5(7)), and if a date of birth under 14 is entered, we do not save it and you can't continue. Under the Civil Act of the Republic of Korea, people under 19 are minors, so Korean Users under 19 must obtain a Legal Guardian's consent as described in Article 5(2). Korean Users under 19 can't use People nearby and aren't shown in it (Article 5(4)).
When we take a measure under Article 24, except in urgent cases, we will tell you the reason and the period in advance and explain how to appeal.
Anyone who claims that a Post infringes their rights, such as by invading their privacy or defaming them, can ask us to delete the Post or publish a rebuttal, by showing prima facie evidence of the infringement through in-app reporting or the contact point in Article 22(1). When we receive a request, we will take the necessary measures, such as deletion or a temporary measure, without delay; notify both the person who made the request and the User who posted the Post; and indicate, where the Post was, that a measure has been taken, so that Users who could see the Post know about it. If it is difficult to determine whether rights have been infringed, or a dispute is expected, we will make the Post unavailable for a period of up to 30 days (temporary measure). During the temporary measure, the User who posted the Post can object and ask for it to be reposted; we will review the objection and tell them the result. If no objection is made by the end of the temporary measure, we may delete the Post. The same procedure applies to Posts that only a limited group of people, such as friends, can see (Article 44-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection). Where we take measures under this paragraph, our liability for damages arising from the distribution of that Post may be reduced or waived under Article 44-2(6) of that Act.
We will not send advertising notifications for commercial purposes without prior consent. If we send them between 9 p.m. and 8 a.m. the next day, we will obtain separate consent. We do not currently send advertising notifications.
These Terms are governed by Japanese law, but the mandatory laws of the Republic of Korea (such as the Act on the Regulation of Terms and Conditions, the Personal Information Protection Act, the Location Information Act and the Act on the Consumer Protection in Electronic Commerce, etc.) apply to Korean Users. However, disputes between Korean Users and us relating to Location Information (Chapter 10) are governed by the laws of the Republic of Korea [TO CONFIRM: Korean counsel (relationship with the governing law provision of these Terms)]. Korean Users can bring an action in either the courts of the Republic of Korea (including the district court that has jurisdiction over the User's domicile at the time the action is brought (or, if the User has no domicile, over their residence)) or the Tokyo District Court. When we bring an action against a Korean User, we will bring it in the court of the Republic of Korea where that User habitually resides (the district court that has jurisdiction over the User's domicile at the time the action is brought (or, if the User has no domicile, over their residence)). If neither the User's domicile nor residence is known at the time the action is brought, we will bring it in the competent court under the Civil Procedure Act of the Republic of Korea (Articles 42 and 47 of the Private International Act; Article 14 of the Act on the Regulation of Terms and Conditions). Article 42(3) does not apply to Korean Users.
If a dispute concerning Location Information or personal information cannot be resolved through discussion, or if discussion is not possible, Korean Users and we may apply to the following bodies for mediation, or consult them [TO CONFIRM: names and contact details of the bodies]:
(1) 개인정보분쟁조정위원회 (Personal Information Dispute Mediation Committee): application for mediation under Article 28(2) of the Location Information Act and Article 43 of the Personal Information Protection Act of the Republic of Korea (phone 1833-6972, https://www.kopico.go.kr)
(2) 개인정보침해신고센터 (Personal Information Infringement Report Center): consultations and reports by Korean Users (phone 118, https://privacy.kisa.or.kr)
If a dispute concerning Location Information cannot be resolved through discussion, or if discussion is not possible, we may apply to the 방송미디어통신위원회 (Broadcasting, Media and Communications Commission) for a ruling under Article 28(1) of the Location Information Act.
The names and contact details of our Location Information Manager (위치정보관리책임자) and Chief Privacy Officer (개인정보 보호책임자) are set out in Article 56 and the Privacy Policy (both are Kaito Asano, Representative Director). You can contact us in Korean.
Under the current statutory criteria, we are not required to designate a domestic agent and have not designated one. If we come to meet the criteria, we will designate one and state this in the Privacy Policy.
In relation to Korean Users, the Korean version of these Terms is the authoritative version (Article 41).
For Korean Users, Article 18(7) applies only to resizing, cropping and format conversion that are technically necessary to provide the Service, and to combining Posts in Exported Videos under Article 20. In all other cases, it does not limit the User's moral rights.
Korean Users may withhold consent with respect to the purposes of use, the range of recipients, parts of the Service, and the method of notification (Article 19(5) of the Location Information Act). If you withhold the consent in paragraph 4, item 2, it is handled as described in that item [TO CONFIRM: Korean counsel (the relationship between making provision to third parties required and stopping Users who withdraw, and Article 19(5) of the Location Information Act and Article 22(5) of the Personal Information Protection Act)].
We collect the personal information of Korean Users directly, and process it in Japan (at ideaccept and in Supabase's Tokyo region) and in the countries of the companies listed in Article 48. Details are set out in the Privacy Policy.
Article 26 of the Location Information Act provides that, to protect the life or body of a child aged 8 or under, a person under adult guardianship, or a person with a mental disability who is registered as a person with a severe disability (together, "children aged 8 or under, etc."), if their guardian consents to the collection, use or provision of their Personal Location Information, the person is deemed to have consented. For this consent, the guardian must submit a written consent form together with a document proving that they are the guardian. A guardian may exercise the rights in Article 53 on the person's behalf. The Service is not intended for children aged 8 or under, etc., and we do not accept use based on a guardian's consent. The Service is not a monitoring service (Article 12(3)).
Article 61 (Users in the EEA, UK and Switzerland)
This Article applies to consumers who habitually reside in the European Economic Area (EEA), the United Kingdom or Switzerland ("EEA/UK/Swiss Users").
We do not limit our liability in the following cases:
(1) damage caused intentionally or through gross negligence by us, our legal representatives or the persons we use to perform our obligations
(2) damage resulting from injury to life, body or health
(3) liability under product liability laws
(4) liability under Article 82 of the General Data Protection Regulation (GDPR) and the UK GDPR, and under other data protection laws
(5) liability under any guarantee we have given
(6) any other liability that cannot be limited by law (in the UK, this includes liability for death or personal injury caused by our negligence (Consumer Rights Act 2015, section 65))
In the cases listed above, we are liable in accordance with the applicable law. This paragraph provides only that the limitations in paragraphs 3 and 4 do not apply in those cases; it does not create any new liability on our part.
For damage caused by slight negligence (meaning negligence other than gross negligence; the same applies in the next paragraph) on our part (including that of our legal representatives and the persons we use to perform our obligations (including our service providers); the same applies in the next paragraph), the damage we compensate is limited, whatever the legal basis of the claim (breach of contract, tort or otherwise), to damage that was typical and foreseeable for a contract for the Service at the time you agreed to these Terms. This paragraph does not apply to cases that fall under paragraph 2.
If, through slight negligence, we breach an obligation that is not an essential obligation (meaning an obligation that is essential for the proper performance of these Terms and on which you can regularly rely), the amount we compensate, whatever the legal basis of the claim, is capped at whichever is higher: the amount you paid us in the 12 months before the date on which the event that caused the damage occurred, or JPY 10,000. If we breach an essential obligation, this cap does not apply and only the preceding paragraph applies. This paragraph does not apply to cases that fall under paragraph 2. The preceding paragraph and this paragraph do not apply to Users who habitually reside in France (Article R212-1, item 6 of the French Consumer Code). [TO CONFIRM: whether to add Italy, Belgium, Spain and other countries (confirm with local counsel before launching there)]
Article 36 does not apply to EEA/UK/Swiss Users. For EEA/UK/Swiss Users, provisions in these Terms that refer to Article 36 are governed instead by paragraphs 2 to 4 of this Article. For EEA/UK/Swiss Users, provisions in these Terms stating that we are "not liable unless it is due to Our Fault" or similar (including Article 26(5) and Article 35(3)) are read, as provided in Article 2, item 22, so that intent or negligence on the part of the persons we use to perform our obligations (including our service providers) is included in Our Fault. These provisions do not change any liability we bear under the law even without negligence (such as product liability), or any burden of proof the law places on us (including our obligation to prove that we are not in any way responsible for the event giving rise to the damage (Article 82(3) GDPR)). For EEA/UK/Swiss Users, the "reasonable security measures" in Article 26(5) means the appropriate measures required by Article 32 GDPR and other laws. The limitations of liability in paragraphs 3 and 4 apply in the same way where a User seeks to hold our officers, employees, legal representatives or the persons we use to perform our obligations personally liable, and those persons may rely on them against the User.
These Terms do not affect your statutory rights as a consumer (including your rights where the Service does not conform to the contract under Directive (EU) 2019/770 on certain aspects concerning contracts for the supply of digital content and digital services). The second sentence of Article 32(1) does not change, to the detriment of EEA/UK/Swiss Users, the legal rules under which whether the Service conforms to the contract is assessed taking into account our public statements (including the Privacy Policy, our website and the App Store description) (such as Article 8 of Directive (EU) 2019/770 and section 50 of the UK Consumer Rights Act 2015). Please note that location information, Together detection, Friends nearby, People nearby, and map and AI results may contain errors, delays and omissions (Article 34(1)), and that the Service is not intended for monitoring people, crime prevention, emergency calls, navigation or tracking people, and does not have the accuracy or reliability needed for those purposes (Article 12(3)).
For EEA/UK/Swiss Users, Article 37 applies only to the extent that the damage results from a breach for which the User is responsible.
These Terms are governed by Japanese law, but EEA/UK/Swiss Users do not lose the protection of the mandatory consumer protection laws of the country where they habitually reside. EEA/UK/Swiss Users may bring proceedings in the courts of the country where they habitually reside. For UK Users, this means the courts of whichever of England and Wales, Scotland or Northern Ireland the User habitually resides in. If we bring proceedings against an EEA/UK/Swiss User, we will bring them in the courts of the country where that User habitually resides. Article 42(3) does not apply to EEA/UK/Swiss Users. For consumers habitually resident in Switzerland, the law determined under Article 120 of the Swiss Federal Act on Private International Law applies, notwithstanding the choice of Japanese law.
We will change these Terms, and the features of the Service (Article 29), only where there is a reason listed in Article 4(2). We will tell you about changes that significantly affect you at least 30 days before the effective date and ask you to agree in the app. We will not treat your silence as agreement. If you don't agree, you can leave free of charge before the effective date, and save your photos, videos, Posts and other content. Unless you agree, the version of these Terms in effect before the change will continue to apply to you. However, we may end our contract with you by giving at least 30 days' notice, as set out in paragraph 10 of this Article.
If we end our contract with an EEA/UK/Swiss User for a reason other than the User's breach, we will give at least 30 days' notice and, during that period, let you retrieve your photos, videos and Posts (including captions, stars, and Spot names and times) free of charge, without hindrance and in a commonly used, machine-readable format (JPEG for photos, MP4 for videos and JSON for everything else). Ending the Service is governed by Article 30. However, for EEA/UK/Swiss Users, the proviso to Article 30(1) applies only where required by the law or an order of a court or government authority, or where there is a serious security risk that threatens Users' safety.
EEA/UK/Swiss Users can end the contract at any time (including within 14 days of entering into it) by deleting their account. There is no charge. Before you delete your account, please save your photos and videos to your device's camera roll or elsewhere (Article 8(4)).
Notwithstanding Article 41, in relation to EEA/UK/Swiss Users, the authoritative version of these Terms is the language version that was displayed in the app when the User agreed to these Terms (the language version kept in the consent record under Article 3(6)). Article 41 and this paragraph do not limit the statutory rights of EEA/UK/Swiss Users (including the right to have unclear terms interpreted in the consumer's favor).
How we handle Posts (information under the Digital Services Act (DSA)):
(1) Content we restrict: anything that falls under the prohibited conduct in Article 23, anything illegal, and anything that falls under Article 21(1)
(2) How we detect it: reports from Users and notices from rights holders (we do not use automated filters). Serious measures such as suspending an account are taken only after review by a person.
(3) Types of measures: as set out in Article 24(2)
(4) Notices of illegal content: you can send a notice through in-app reporting or Contact us, stating what the content is, why you believe it is illegal, your name and contact details (optional where the law does not require them), and a statement that you believe the notice is accurate. We will confirm receipt of your notice without undue delay and tell you our decision and the available means of redress.
(5) Statement of reasons: when we restrict Posts or accounts, we will tell you what the measure is and how long it lasts, the facts and circumstances it is based on, whether automated means were used, the grounds (the law or the provision of these Terms relied on), and the available means of redress.
(6) Appeals: Users subject to a measure, and people who submitted a notice, can appeal free of charge within 6 months of being notified of the measure. A person will review the appeal. Where available under the law, you can also use a certified out-of-court dispute settlement body, and you can go to court.
(7) If we become aware of information giving rise to a suspicion of a criminal offence that threatens a person's life or safety, we will inform the relevant authorities.
Our contact points and representatives are:
(1) Single point of contact for authorities and users (DSA Articles 11 and 12): contact@ideaccept.com (languages: Japanese, Korean and English). Users can contact us by means that are not solely automated.
(2) Legal representative under DSA Article 13 and EU representative under GDPR Article 27: [TO CONFIRM: name and contact details of the EU representative (to be appointed before launching in the EU and the UK)]
(3) UK representative under UK GDPR Article 27: [TO CONFIRM: name and contact details of the UK representative (to be appointed before launching in the EU and the UK)]
(4) Swiss representative under Article 14 of the Swiss Federal Act on Data Protection: [TO CONFIRM: whether one must be appointed]
For users in the UK, we will provide procedures for reporting illegal content and making complaints under the Online Safety Act 2023 [TO CONFIRM: preparations needed before launching in the UK].
The legal bases on which we process the Personal Location Information of EEA/UK/Swiss Users are as follows:
Processing Legal basis Location while the app is open, Spot recording, place name suggestions and search, walked route (on your device), Together detection, showing Posts to friends, Friends nearby, hiding the area around your Home, Community Places (including sending place names to AI to decide the category and the more specific type, producing the specific type in three languages, and showing place names in three languages), exports (including your profile photo and display name appearing in exports made by friends you were with (Article 20)), being shown in People nearby (as described in the note for the checkbox in Article 3(1), item 4) Performance of a contract (Article 6(1)(b) GDPR) "Always" location, sending photos taken with the rear camera to AI to decide the category of Community Places (Article 14(2)) Consent (Article 6(1)(a) GDPR) Preventing misuse, responding to reports, Location Disclosure Records Legitimate interests (Article 6(1)(f) GDPR: protecting Users' safety, investigating misuse, and meeting record-keeping obligations under Japanese and Korean law). Responding to reports as required by EU law (such as the Digital Services Act) is based on legal obligation (Article 6(1)(c) GDPR) We obtain consent from EEA/UK/Swiss Users with the same checkboxes as for all Users, as set out in Article 3(1). However, we do not treat the [Required] checkboxes (these Terms, the collection and use of personal information, the collection and use of location information, and the provision of Personal Location Information to third parties), or agreement to the Privacy Policy and Chapter 10 as presented with those checkboxes, as consent under Article 6(1)(a) GDPR. Those checkboxes serve to confirm your intention to accept these Terms and enter into the contract and that you have been informed about the processing; the legal basis for the corresponding processing (processing necessary for the core features of the Service, including providing your location to friends (Together detection, showing your Posts to friends, and Friends nearby)) is performance of a contract (Article 6(1)(b) GDPR), as set out in the table in the preceding paragraph. Of the checkboxes in Article 3(1) and the question about photos for AI, the only ones we treat as consent under Article 6(1)(a) GDPR are the [Optional] usage analytics checkbox (Article 3(1), item 5) and sending photos to AI (Article 14(2)) (the other processing based on consent in the table in the preceding paragraph ("Always" location) is subject to separate consent through your device's location permission). You may withdraw consent for processing based on consent at any time; withdrawal does not affect the lawfulness of processing carried out before you withdrew, and we will not stop you from using the Service because you withdrew it. If an EEA/UK/Swiss User withdraws the checkbox for the provision of Personal Location Information to third parties, stopping that User's use of the Service does not place a condition on the withdrawal of consent; we treat it as termination of the contract for the Service because the User no longer accepts a core element of the Service (providing their location to friends) [TO CONFIRM: EEA counsel (not treating the [Required] checkboxes as consent under Article 6(1)(a) GDPR, and characterizing stopping Users who withdraw the checkbox for provision to third parties as termination of the contract)]. In that case, when you open the app we let you choose whether to tick the checkbox again or delete your account, and before you delete your account you can save your photos and videos as set out in paragraph 11.
EEA/UK/Swiss Users may object at any time to processing based on legitimate interests (the table in paragraph 16). You can object by contacting us at contact@ideaccept.com. Sending photos to AI is based on consent (the table in paragraph 16), and you can withdraw that consent at any time with "AI > Help build the map for everyone" in the app settings. If you withdraw it, we will stop sending photos to AI for that account and determine the category from the place name alone (Article 14(2)).
EEA/UK/Swiss Users have the rights of access, rectification, erasure, restriction of processing and data portability, and may lodge a complaint with a supervisory authority, such as the one in the country where they habitually reside. Details are set out in the Privacy Policy.
Article 62 (Users in the United States)
This Article applies to Users who live in the United States ("US Users").
THE SERVICE (INCLUDING ITS LOCATION FEATURES, SUCH AS TOGETHER DETECTION, FRIENDS NEARBY AND PEOPLE NEARBY, MAP AND PLACE INFORMATION, AI RESULTS, AND CONTENT PROVIDED BY OTHER USERS OR EXTERNAL SERVICES) IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, NON-INFRINGEMENT AND ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. IN PARTICULAR, WE DO NOT WARRANT THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTION, SECURELY, OR FREE OF ERRORS OR HARMFUL COMPONENTS; THAT DATA WILL NOT BE LOST; THAT LOCATION INFORMATION OR THE RESULTS OF TOGETHER DETECTION, FRIENDS NEARBY OR PEOPLE NEARBY WILL BE ACCURATE OR COMPLETE; OR THAT SETTINGS SUCH AS GHOST MODE, BLOCKING OR HOME HIDING WILL ALWAYS PREVENT OTHERS FROM LEARNING OR INFERRING YOUR WHEREABOUTS. NO DESCRIPTION IN THE APP (ARTICLE 32(1)), THE PRIVACY POLICY, OR ANY OTHER ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THIS PARAGRAPH. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THAT PART MAY NOT APPLY TO YOU.
WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL OR USE, OR THE COST OF SUBSTITUTE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, UNDER ANY LEGAL THEORY, IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE DATE ON WHICH THE CAUSE OF THE CLAIM AROSE, OR USD 100. THE LIMITATIONS IN THIS PARAGRAPH APPLY EVEN IF ANY REMEDY IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE. THE DISCLAIMERS AND LIMITATIONS IN PARAGRAPH 2 AND THIS PARAGRAPH ALSO APPLY FOR THE BENEFIT OF OUR OFFICERS, EMPLOYEES AND AGENTS AND THE COMPANIES WE USE TO PROVIDE THE SERVICE. THE LIMITATIONS IN THIS PARAGRAPH DO NOT APPLY TO LIABILITY FOR INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE (INCLUDING WILLFUL MISCONDUCT) OR FRAUD BY US (INCLUDING OUR OFFICERS, EMPLOYEES AND AGENTS AND THE COMPANIES WE USE TO PROVIDE THE SERVICE; THE SAME APPLIES THROUGHOUT THIS SENTENCE), TO LIABILITY FOR DEATH, BODILY INJURY, SICKNESS OR DISEASE CAUSED BY OUR NEGLIGENCE, TO LIABILITY FOR ANY VIOLATION OF LAW (WHETHER WILLFUL OR NEGLIGENT) THAT APPLICABLE LAW, SUCH AS CALIFORNIA CIVIL CODE SECTION 1668, DOES NOT ALLOW TO BE LIMITED, OR TO ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. MENTAL OR EMOTIONAL DISTRESS, INVASION OF PRIVACY, DEFAMATION AND SIMILAR HARM NOT ACCOMPANIED BY BODILY INJURY, SICKNESS OR DISEASE DO NOT FALL WITHIN THE EXCEPTION FOR DEATH, BODILY INJURY, SICKNESS OR DISEASE. THESE EXCEPTIONS PROVIDE ONLY THAT THE LIMITATIONS IN THIS PARAGRAPH DO NOT APPLY WHERE WE ARE LIABLE UNDER APPLICABLE LAW; THEY DO NOT CREATE ANY NEW LIABILITY ON OUR PART. SOME STATES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
Article 36(2) to (4) do not apply to US Users. For US Users, provisions in these Terms that refer to Article 36 are governed instead by paragraphs 2 and 3 of this Article. For US Users, provisions in these Terms that describe cases that are due to Our Fault or in which we will compensate for damage (such as Article 26(4), Article 33(3), Article 36(1) and Article 55(3)) confirm that paragraphs 2 and 3 of this Article apply where we are liable under applicable law; they do not impose on us any obligation or liability beyond what applicable law provides. The parts of these Terms, the Privacy Policy and the descriptions in the app that describe how the Service works or what we do (such as the time within which we review reports (Article 24(4)) and how Ghost mode, blocking and home hiding work) describe our policies and how the Service is intended to work; they are not a promise to US Users that the Service will always work that way.
For Users who live in New Jersey, paragraph 3 does not limit claims under the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) (including treble damages and attorneys' fees), claims under the New Jersey Products Liability Act (N.J.S.A. 2A:58C-1 et seq.) or claims under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act (N.J.S.A. 56:12-14 et seq.), and the exclusion of punitive damages in paragraph 3 does not apply where the New Jersey Punitive Damages Act (N.J.S.A. 2A:15-5.9 et seq.) allows punitive damages. Paragraph 16 (the one-year period for claims) does not apply to claims under the New Jersey Consumer Fraud Act or the New Jersey Law Against Discrimination (N.J.S.A. 10:5-1 et seq.); those claims are subject to the periods provided by law. The jury trial waiver in paragraph 9 (for claims decided in court) does not apply to claims under the New Jersey Law Against Discrimination, and applies to all other claims. Where these Terms state that provisions may not apply under certain laws or in certain states, or apply to the extent permitted by law (Article 31(1); the proviso to Article 58(1); in paragraph 3 of this Article, the exceptions for liability for violations of law that applicable law does not allow to be limited and for any other liability that cannot be limited under applicable law, and its last sentence; the last sentence of paragraph 9; paragraph 10; the second sentence of paragraph 16; paragraph 17; and Article 63(5)), for New Jersey this refers to the parts identified in this paragraph. The other provisions of these Terms (including paragraphs 2, 6 and 7 of this Article) also apply to Users in New Jersey [TO CONFIRM: New Jersey counsel].
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. YOU RELEASE US FROM CLAIMS ARISING OUT OF THE CONDUCT OF OTHER USERS ITSELF, EXCEPT CLAIMS ARISING FROM INTENTIONAL MISCONDUCT OR NEGLIGENCE BY US (INCLUDING OUR OFFICERS, EMPLOYEES AND AGENTS AND THE COMPANIES WE USE TO PROVIDE THE SERVICE, AND INCLUDING BREACH OF OUR OWN OBLIGATIONS), FRAUD, OR VIOLATION OF LAW (WHETHER WILLFUL OR NEGLIGENT). CLAIMS ARISING FROM OUR ORDINARY NEGLIGENCE ARE SUBJECT TO THE LIMITATIONS IN PARAGRAPH 3. WE DO NOT VERIFY, AND HAVE NO OBLIGATION TO VERIFY, USERS' IDENTITIES, THE ACCURACY OF THE DATES OF BIRTH OR AGES THEY PROVIDE, OR THEIR CRIMINAL RECORDS. LIMITING PEOPLE NEARBY TO USERS AGED 18 OR OLDER (ARTICLE 5(4)) DEPENDS ON THE DATES OF BIRTH USERS PROVIDE, AND PEOPLE WHO MISREPRESENT THEIR AGE OR IDENTITY MAY APPEAR IN PEOPLE NEARBY OR AMONG YOUR FRIENDS. YOU UNDERSTAND THE RISKS OF COMMUNICATING WITH OR MEETING OTHER USERS (INCLUDING PEOPLE YOU SEE IN PEOPLE NEARBY) AND OF YOUR WHEREABOUTS BEING CONVEYED TO THEM, AND YOU ASSUME THOSE RISKS. IF YOU LIVE IN CALIFORNIA, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542 TO THE EXTENT OF THIS RELEASE. SECTION 1542 STATES: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." To the extent of this release, you also waive any similar law of any other state (such as Montana Code Annotated § 28-1-1602, North Dakota Century Code § 9-13-02 and South Dakota Codified Laws § 20-7-11).
You will defend, indemnify and hold harmless us (including our officers, employees and agents) from and against third-party claims arising out of or relating to the following, and the resulting damages, settlement amounts and costs (including reasonable attorneys' fees), except to the extent that the claim arose from our intent or negligence:
(1) your Posts
(2) your breach of these Terms or the law
(3) your infringement of a third party's rights
(4) anything you do using other Users' information that you learned through the Service (including information about their whereabouts), and your conduct in communicating with or meeting other Users
We will notify you promptly when we become aware of a claim. We may choose to assume the exclusive defense and settlement of the claim at your expense, in which case you will cooperate with us as we request. Even if we do not assume the defense, we may participate in the defense at our own expense. You may not settle any claim in a way that imposes an obligation on us or admits liability on our behalf without our prior written consent.
ARBITRATION AGREEMENT. THIS AGREEMENT INCLUDES A WAIVER OF YOUR RIGHT TO HAVE DISPUTES DECIDED IN COURT AND YOUR RIGHT TO A JURY TRIAL. PLEASE READ IT CAREFULLY. The arbitration agreement is as follows:
(1) Scope: all disputes between US Users and us relating to these Terms or the Service (including disputes based on contract, tort or statute). This also includes claims against our officers, employees and agents and the companies we use to provide the Service that relate to these Terms or the Service, and disputes that arose before the US User agreed to these Terms.
(2) Informal negotiation first: before starting arbitration, the party raising a dispute must send the other party a written notice (email is acceptable) stating their name, contact details, account, the nature of the claim and the relief sought, and the parties must negotiate in good faith for 60 days. Statutes of limitations are tolled during this period. Notices to us must be sent to contact@ideaccept.com. We will send notices to you at your registered email address (if any) or in the app. Each notice must be personally signed (electronic signatures are acceptable) by the US User making the claim and sent individually for that User (if the User has a representative, the representative must also sign it). If either party asks, the parties will hold an individual conference by telephone or online.
(3) ARBITRATION: ANY DISPUTE NOT RESOLVED THROUGH NEGOTIATION WILL BE RESOLVED BY INDIVIDUAL, BINDING ARBITRATION. The arbitration will be conducted by a single arbitrator under the American Arbitration Association (AAA) Consumer Arbitration Rules and, where applicable, the Mass Arbitration Supplementary Rules. The arbitration will take place in the county where the US User lives, or by telephone, online or on written submissions. Arbitration fees are governed by the AAA rules [TO CONFIRM: registration in the AAA Consumer Clause Registry]. This arbitration agreement (including its formation, validity, scope and enforceability) is governed by the Federal Arbitration Act and, to the extent not inconsistent with it, the state law described in paragraph 9; the Arbitration Act of Japan does not apply to it.
(4) Exceptions: either party may bring an individual claim in small claims court if it qualifies. Claims for public injunctive relief that are available under the law will be decided in court (in that case, those court proceedings will be stayed until the arbitration of the other claims is completed). Either party may seek an injunction in court to stop infringement of intellectual property rights or unauthorized use of the Service (Article 23, items 14 to 16).
(5) CLASS ACTION WAIVER: YOU AND WE MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, CLASS ARBITRATION OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE THE RIGHT TO A TRIAL BY JURY. If the class action waiver is found invalid for a particular claim, that claim will be decided in court, not in arbitration.
(6) Opting out: US Users can opt out of this arbitration agreement by sending their name, user ID and a statement that they want to opt out of arbitration to contact@ideaccept.com within 30 days of the date they first agreed to these Terms. If you opt out, the other provisions of these Terms still apply.
(7) Changes: if we change this arbitration agreement, the previous version applies to disputes that arose before the change. US Users can keep the previous version by rejecting an unfavorable change within 30 days of being notified of it.
(8) Who decides: the arbitrator decides all disputes about the scope, interpretation, applicability, enforceability or formation of this arbitration agreement, except that a court decides whether the class action waiver in item (5) is enforceable, whether a claim seeks public injunctive relief under item (4), and whether a claim qualifies for small claims court. This arbitration agreement prevails over any dispute resolution provision in Chapter 10 (Location Information) or the Privacy Policy. This arbitration agreement survives the end of your contract to use the Service and applies to disputes arising after it ends (including disputes about how data is handled after you delete your account).
(9) Severability: except as provided in item (5), if any part of this arbitration agreement is found invalid or unenforceable, only that part is removed and the rest remains in effect. If the AAA cannot or will not administer the arbitration, the arbitration will be conducted in accordance with this arbitration agreement by another arbitration provider agreed by the parties (or, if they cannot agree, by an arbitrator appointed by a court under Section 5 of the Federal Arbitration Act).
Notwithstanding Article 42(2) and (3), as between US Users and us, all claims relating to these Terms and the Service (including claims based on contract, tort or statute) are governed by the federal law of the United States (including the Federal Arbitration Act and 47 U.S.C. § 230) and, to the extent not inconsistent with federal law, the laws of the state where the US User lives (excluding that state's conflict of laws principles) [TO CONFIRM: US counsel (governing law for US Users)]. For claims that are not subject to arbitration, US Users can bring an action in the state or federal courts with jurisdiction over the state and county where they habitually reside. FOR CLAIMS DECIDED IN COURT (INCLUDING WHERE A CLAIM FALLS OUTSIDE PARAGRAPH 8 AND IN THE CASES DESCRIBED IN PARAGRAPH 8, ITEM (4)), YOU AND WE ALSO WAIVE THE RIGHT TO A TRIAL BY JURY, EXCEPT WHERE THE LAW OF THE STATE WHERE YOU LIVE DOES NOT ALLOW SUCH A WAIVER IN ADVANCE.
These Terms do not limit any rights or remedies of US Users that cannot be waived by contract, including those under the California Consumer Privacy Act (CCPA). We do not sell personal information (including precise geolocation), and we do not share it (that is, share it for cross-context behavioral advertising). We use precise geolocation only to provide the features you request, to keep the Service secure, to prevent fraud and stalking, and to comply with the law (except when we create statistics aggregated sufficiently that no specific person or home can be inferred). Wherever in the United States you live, we collect and use precise geolocation (Article 3(1), item 3) and provide it to other Users (item 4 of that paragraph) only after obtaining your consent (opt-in) in advance with the respective [Required] checkboxes. Where state law treats precise geolocation as sensitive data (including state laws that require consent to process sensitive data), we treat those checkboxes as consent under that law. We treat provision to other Users as an intentional disclosure at your direction, not as a sale or sharing. For California Users as well, we treat the checkbox for the provision of Personal Location Information to third parties as your consent (opt-in) to provision to other Users, and you can withdraw this consent at any time in Settings (what happens if you withdraw it is set out in Article 3(4)). Because we use and disclose precise geolocation only for the purposes permitted by the CCPA regulations (Cal. Code Regs. tit. 11, § 7027(m)), we don't handle it in any way that would give rise to the right to limit the use and disclosure of sensitive personal information [TO CONFIRM: US counsel (the relationship between consent to sensitive data under state law and the right to limit under the CCPA)].
Copyright infringement notices (under the Digital Millennium Copyright Act (DMCA)) should be sent to our designated agent: [TO CONFIRM: name and contact details of the DMCA designated agent]. A notice must include the copyrighted work, where the allegedly infringing Post is, your contact details, a statement of good faith, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your signature (17 U.S.C. §512(c)(3)). Users whose Posts have been removed may send a counter-notification. A counter-notification must include your signature; identification of the removed Post and where it appeared; a statement under penalty of perjury that you have a good faith belief that it was removed as a result of mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you live outside the United States, any judicial district in which we may be found) and that you will accept service of process from the person who sent the notice (§512(g)(3)). We will restore the Post within 10 to 14 business days after receiving a counter-notification unless the person who sent the notice informs us that they have filed a lawsuit. Anyone who knowingly makes a material misrepresentation in a notice or counter-notification may be liable for damages (§512(f)). Where appropriate, we will delete the accounts of Users who repeatedly infringe copyrights.
The Service is not directed at children under 13. People below the age set in Article 5 cannot use the Service. If a date of birth showing an age under 13 is entered on the date of birth screen, we do not save it and the person can't continue. If we learn that we have collected personal information from a child under 13, we will delete it.
The Service is currently free of charge. Users who live in California may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 [TO CONFIRM: current address and number].
We are not the publisher or speaker of content posted or entered by other Users (including Posts, comments, profiles and the names of Community Places). We have no obligation to monitor, in advance or at all times, the content shown in the Service or Users' conduct. Our handling of reports, hiding or deleting Posts, suspending accounts and similar actions are measures we take in good faith; they do not create any new obligation, toward US Users or anyone else, to take those actions or to protect anyone from other Users. We are entitled to the protections of 47 U.S.C. § 230 (the Communications Decency Act), and nothing in these Terms (including Article 42(2)) waives or limits those protections.
Requests to remove intimate images or videos published without consent (including those created with AI) (TAKE IT DOWN Act): the person depicted (or a person authorized to act on their behalf) can request removal through in-app reporting or at contact@ideaccept.com by sending a signature (electronic signatures are acceptable), information sufficient for us to locate the image or video, a brief statement that they have a good faith belief that it was published without their consent, and their contact information. We will remove it within 48 hours after receiving a valid request and make reasonable efforts to find and remove identical copies. As provided in that Act, we are not liable for removals we make in good faith in accordance with it [TO CONFIRM: implementation (a process for removal within 48 hours and guidance on the reporting screen)].
YOU AND WE MUST BRING ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, IN ARBITRATION (PARAGRAPH 8) OR IN COURT (IN THE CASES DESCRIBED IN PARAGRAPH 8, ITEM (4) AND PARAGRAPH 9), WITHIN ONE YEAR AFTER THE CAUSE OF THE CLAIM AROSE; OTHERWISE, THE CLAIM IS PERMANENTLY BARRED. HOWEVER, THIS PARAGRAPH DOES NOT APPLY TO CLAIMS FOR DEATH, BODILY INJURY, SICKNESS OR DISEASE, OR TO CLAIMS FOR WHICH THE LAW DOES NOT ALLOW THE LIMITATION PERIOD TO BE SHORTENED BY CONTRACT; THE PERIOD PROVIDED BY LAW APPLIES TO THOSE CLAIMS. THIS PERIOD IS TOLLED DURING THE INFORMAL NEGOTIATION UNDER PARAGRAPH 8, ITEM (2). THIS PARAGRAPH IS NOT PART OF PARAGRAPH 8 (THE ARBITRATION AGREEMENT), AND IF THIS PARAGRAPH IS FOUND INVALID OR UNENFORCEABLE, THAT DOES NOT AFFECT THE VALIDITY OF PARAGRAPH 8.
For US Users, notwithstanding the last sentence of Article 40, if any provision of these Terms (other than the arbitration agreement in paragraph 8, to which paragraph 8 applies) is found invalid or unenforceable, that provision will be enforced to the maximum extent enforceable, with the invalid or unenforceable part removed, in the form closest to the purpose of the original provision.
Notwithstanding Article 41, in relation to US Users, the English version of these Terms is the authoritative version.
On the sign-in screen and the one-time confirmation screen described in Article 3(1), in the text of the "[Required] Agree to the Terms of Service" checkbox, in text the same size as the surrounding text, we state that these Terms include the arbitration agreement for US Users (paragraph 8, which includes the waiver of class actions and jury trials), and we show the links to the Terms of Service and the Privacy Policy in a color that distinguishes them from the surrounding text (this notice is shown to all Users). By ticking that checkbox, US Users agree to these Terms, including paragraph 8.
If a US User is under 18 (or under the age of majority in the state where they live, if that is higher than 18), the User promises that their parent or guardian (Legal Guardian) has read and agreed to these Terms (including the arbitration agreement in paragraph 8) on their behalf. A parent or guardian who has agreed is bound by these Terms with respect to the User's use of the Service.
Article 63 (If You Obtained the App from the App Store)
The following provisions apply to Users who obtained the Service's app from Apple's App Store.
These Terms are a contract between you and us, and not with Apple Inc. ("Apple"). We, not Apple, are responsible for the app and its content. These Terms apply to the extent they do not conflict with the App Store's terms of use (the Apple Media Services Terms and Conditions).
The license we grant you to use the app is a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the App Store's terms of use, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
We alone are responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance and support services for the app.
We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and, as between Apple and us, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
We, not Apple, are responsible for addressing any claims relating to the app or your possession and use of the app, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation. These Terms do not limit our liability beyond what is permitted by law.
If a third party claims that the app, or your possession and use of the app, infringes that third party's intellectual property rights, we, not Apple, will be responsible for the investigation, defense, settlement and discharge of that claim.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Please send any questions, complaints or claims about the app to the operator contact details at the end of these Terms.
When using the app, you must comply with the terms of any applicable third-party agreements (such as your mobile carrier's service agreement).
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Supplementary Provision
These Terms take effect on [EFFECTIVE DATE].
